Show 1 Page X' The Pyramid Eight August 1. 1984 Mayfield businessman threatens lawsuit MAYFIEL- local A D- businessman who suffered what he said were massive damages when the Mayfield irrigation dam broke on July 16 has hired an attorney and unless an amicable agreement is reached says he will sue the parties re onsible for the dams failure, according to Brent P. Lorimer, the mans attorney. Daniel Good, owner and operator of Mountain Auto Wrecking, said he lost an unestimated amount of inventory in the dam break, including antique car parts he had been collecting for years, Goods attorney commented, as to whose fault it is, we dont know, but law suits will be initiated to at least-threparties. The irrigation company, the people who constructed the dam and people who designed the dam were implicated as the three primary parties involved in the potential suit. The law suit will be filed very quickly, the attorney continued, but we dont know how long before it can be settled. The suit will start with a claim and complaint Tiling. No dollar figure has yet been placed on the suit, he said. Lorimer of Salt Lake City, related that one of the parties, the irrigation company, has already contacted Good with their attorney, but said Good was not satisfied with their contact. Lorimer related that prior to Good suggested construction moving the site of the dam off to the side near some corrals owned by the Mayfield Irrigation Company so it wouldnt cause a problem to the city Pioneer Day fun run FAIRVIEW- - Clay Yardley and Charlotte Collard took top honors in the Pioneer Day Fun Run in Fair-vie- July 24. The Goods, acting under the advice of Lorimer, their attorney, were unable to make a comment on the proposed suit. The dam was constructed under the direction of the Utah State Water Resources Board. Dee Hansen, state engineer, reported that his office has received only a preliminary report on the cause of the dam failure. A more detailed report is being made by a private engineering firm, Chinn and Associates, of Salt Lake City. Hansen reported that the design of the dam is the same one being used for similar dams throughout the country and is approved for use by the Department of Water Resources. There are 900 dams in Utah and considering the heavy water year, it was not surprising that there would be a dam failure, Hansen said. There were actually two dam failures this year, the one in Mayfield and one on White Pine Lake in Little Cottonwood Canyon. The second dam failure did not a quick release of water and little damage was attributed to that incident, Hansen related. That reservoir was manually drained and is being repaired. Also, .Hansen, commented, there was no loss of life in either incident. The Mayfield dam appeared to have some failure around the cut off collars in the dams filtering system. The state may accept a new design in the dams repair and take out the cut off collars and replace that system with a different filtering system. Also, there has been a move' to change the design of smaller dams, he said. Hansen also said that an inspector had been on the site of the dam and that all construction requirements, including compaction of the fill materials, were mef. All dams have water seeping through them, Hansen explained. Dams are constructed with a fairly sophisticated system, and utilize clay, porous material ..and even heavy gravel and rock for proper drainage. President of the Mayfield Irrigation Company, Douglas Willden, did not wish to make any comment regarding the alledged suit. He did say, however, that an estimate for the entire amount of damage including the repair of the dam had not been set, and that although an estimate of $10,000 has been made for dam repairs, the Department of .Water Resources would have to make the final analysis on how the repairs would be made.
