The first ordinance (89) establishes development fees. The second ordinance (90) would establish minimum standards of building construction and fees for building permits. The third ordinance (91) would restrict the construction of buildings and structures, excepting private residences, for three months. ordinances are printed below in The their entirety and will become effective on August I, 1979. The Millard County Commission has provided an appeal period of thirty days, beginning July I, 1979. He was a bookkeeper for Utah Power & Light and was a chief deputy assessor in Weber County. He served in many capacities in the LDS Church including bishop of the Ogden 17th Ward, and was active in civic groups. SECTION II. That all ordinances of Millard County, Utah which conflict in whole or in part with the provisions of this ordinance are hereby repealed to the extent of such conflict. ORDINANCE NO. 90 MINIMUM ESTABLISHING AN ORDINANCE STANDARDS TO SAFEGUARD LIFE OR LIMB. HEALTH, PROPERTY AND PUBLIC WELFARE BY AND CONTROLLING DESIGN, REGULATING CONSTRUCTION, QUALITY OF MATERIALS, USE AND AND LOCATION OCCUPANCY, MAINTENANCE OF ALL BUILDINGS AND STRUCTURES WITHIN MILLARD COUNTY. NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSIONERS AS BOARD OF COUNTY FOLLOWS: Section 1. UNIFORM BUILDING CODE ADOPTED. The Uniform Building Code, 1975 edition (UBC) with its Appendix as adopted by the International Conference of Building Officials, is hereby adopted except for the amendments noted in this ordinance. Section 2. AMENDMENT OF SECTION 202(g). The first line of Section 202(g) is hereby amended to insert the words and Board of Appeals after the words Building Official. Section 3. AMENDMENT OF SECTION 204. Section of the Uniform Building Code is amended to read as follows: Section 204. Board of Appeals. In order to determine the 204 suitability of alternate materials and methods of construction and to provide for reasonable interpretations of the provisions of the Code, there shall be and is hereby created a Board of Appeals, consisting of three members who are qualified by experience and training to pass upon matters pertaining to building construction. Section 204(A). Appeals to the Board of Appeals. The Board may review the application of any provisions of the Code or any order, decisions or interpretation of the Building Official, when appealed to, in writing by an aggrieved person, within 10 days of the decision rendered by the Building Official. Section 204(B). Action by the Board. The Board of Appeals where so appealed to and after a hearing, may vary or waive the application of any provision of this code to a particular case when, in its opinion, an exceptional situation or condition exists and strict application of the Code would result in unusual practical difficulties or create undue hardships upon the applicant and the enforcement thereof would be contrary to the spirit and purpose of this Code. In waiving or varying any provision of this Code, the Board shall set forth in its findings the exceptional situation or condition that exists and the reasons for the waiver or variance together with the specific finding why said waiver or variance will not be detrimental to the public health, safety and welfare. Section 4. AMENDMENT OF SECTION 205. It shall be unlawful for the utility companies to provide electrical service to any building, or to service equipment or wiring, which are subject to the provisions of this Code and for which a permit is required, until approval is granted by the Building Official. The Building Official may order utility services terminated at any location where the use is not authorized or is in violation of the building, zoning or other city, county or state ordinances and statutes. Section 5. AMENDMENT OF SECTION 301(a). Section 301(a) is amended to read as follows: Section 301(a). Permits Required. No person, firm or corporation shall erect, construct, enlarge, alter, repair, improve, remove, convert, or demolish any building or structure in Millard County greater than 200 sq. ft., or cause the same to be done, without first obtaining a separate building permit for each such building or structure from the Building Official. Section 5a. AMENDMENT OF SECTION 301(b). Section 301(b) is hereby amended to delete the words; "State the valuation of the proposed work". Section 6. AMENDMENT OF SECTION 303(a). Section 303(a) is amended to read as follows; A. A fee for each building permit shall be paid to Millard County as follows: (1) Residential - Fees for residential construction shall be $.06 per square fool, including the basement. The minimum fee for a residential building permit shall he $30.00. Commercial and Industrial (2) Commcrciallndustrial construction will be assessed a fee at the rale of $.10 per square foot for floor area. The minimum fee shall be $45.00. (3) Accessory Buildings & Structures - All accessory buildings and structures shall he charged a; the rate of $.03 per square foot or $.03 per linear foot as the case may apply. The minimum fee shall be $10.00. (4) Signs - A set fee of $15.00 shall be paid for all signs requiring a building permit as required by the provisions of this code and any other city, county or state ordinances. (5) Move on (including Mobile Home) The fee to move a building, structure or mobile home on a property shall be $.05 per square foot of floor area or covered aica as may apply. Where work for which a permit is required by this Code is started or proceeded with prior to obtaining said permit, the fees specified in the Building Permit Fee Schedule shall be doubled, but the payment of such double fee shall not relieve any persons from fully complying with the requirements of this Code in the execution of the work nor from any other penalties prescribed herein. Section 7. AMENDMENT OF SECTION 1501 DIVISION 2. The first line of Section 1501 Division 2 is hereby amended to insert the words, "fences on corner lots", after the words, "fences over 6 feet high. Section 8. ENFORCEMENT OF OTHER BUILDING REGULATIONS. The Administrative portion of the UBC, Part I, Chapters I, 2, and 3, is hereby adopted, incorporated and made applicable to the administration and enforcement of the provisions of the National Electric Code as adopted in Section II herein, and the Utah Plumbing Code as adopted in Section 9 herein. Section 9, UTAH PLUMBING CODE, 2ND REVISION, ADOPTED. The Utah Plumbing Code, as adopted by the Utah State Board of Health December 2, 1964, and as amended to date of this ordinance is hereby adopted and incorporated herein by reference, with the following additions; (1) Drains. (a) Drain lines draining to both an automatic washer and a kitchen sink shall be 2 inches or larger. (b) All basements or cellars shall have a floor drain. Where the drain line is above the basement floor line a pump or lift shall be installed. (c) Each water heater shall have a drain adjacent to it. Water heaters installed on wood floors or in alter spaces shall drain in an acceptable manner. (2) Low Flush Toilets. No toilets which use more than four (4) gallons of water per flush shall be installed in hotels, motels, apartment houses, dwellings, or other structures which have toilets or water closets. Any toilets or water closets installed prior to the effective date of this ordinance shall meet the standards of this section when replaced. All fixtures installed pursuant to the provisions of this ordinance shall be of a design such that the walls of the toilet or water closet bowl are thoroughly washed and the contents discharged with each flush. Section 10. FEES FOR PLUMBING PERMIT. The minimum fee charged for plumbing permits shall be $10.00. If there are more than three plumbing fixtures the charge shall be $10.00 plus $2.00 for each plumbing fixture in excess of three. Section 11. NATIONAL ELECTRICAL CODE ADOPTED. The National Electric Code, 1975 Edition of the National Fire Protection Association, printed as a code book form with all amendments thereto to the date of this ordinance, is hereby adopted and incorporated herein by reference. Section 12. FEES FOR ELECTRICAL PERMITS. (1) Fees for Permits and Inspection are: (a) For remodeling existing residential occupancies or house moved to a new location: One cent per square foot based on the approved plan with a minimum of $10.00. (b) Commercial: For other than residential occupancies, new work, alterations or repairs, fees shall be computed at $.03 per square foot, based on the area included in the approved plan with a minimum of $10.00. Section 13. BUILDING OFFICIAL PROHIBITED FROM ENGAGING IN BUSINESS. It shall be unlawful for the Building Official or any of his assistants to engage in the building, electrical, plumbing, or heating and business, either directly or indirectly within their jurisdiction, and they shall have no financial interest in any concern engaged in such business in Millard County at any time while holding such a position. Section 14. This Ordinance shall take effect fifteen (15) days after its passage and upon at least one publication in a newspaper published and having general circulation in Millard County, Utah. ORDINANCE 91 An ORDINANCE regulating, controlling and restricting the construction, erection or alteration of buildings or structures on any premises within Millard County, Utah. And authorizing the Planning Commission to classify areas for comprehensive zoning regulation. This resolution and ordinance is to control the use of property pending completion of Master Plan and Zoning Ordinances, and for three months. BE IT ORDAINED by the County of Millard, State of Utah: Section 1. That it shall hereafter be, and it is hereby declared to be unlawful for any person, persons, firm, partnership, or corporation to erect or construct, alter, or maintain, or cause or permit to be erected, constructed, altered or maintained, on any premises within the unincorporated areas of Millard County, any building or buildings which shall be used for any purpose other than a private residence during a period of three months from date of adoption and pending the completion by the Commission of a Master Plan and Zoning Ordinance. Section 2. Any person, persons, firm, partnership or corporation, who constructs or erects or who begins the erection, construction, or alteration or who causes the beginning or the erection, construction, or alteration of any such building on any premises within (he unincorporated area of Millard County, Utah, within the three month period without having obtained an exception permit in accordance with this ordinance, shall be guilty of a misdemeanor and on conviction thereof shall be fined not more than Two Hundred ninety-nin- e ($299.00) dollars, or by imprisonment for a period of not exceeding six (6) months, or by such fine and imprisonment. Section 3. Each day any violation of this ordinance continues shall be deemed a separate offense. Section 4. Exception appeal to the Board of County Commissioners. The Board of County Commissioners where so applied to and after receipt of opinion of the staff and Planning Commission, may vary or waive any provision of this ordinance to a particular case when in its opinion, an exceptional situation or condition exists and strict application of this ordinance would result in unusual practical difficulties or create undue hardship upon the applicant and the enforcement thereof would be contrary to the spirit and purpose of this ordinance. In waiving or varying any provision of this ordinance, the Board of County Commissioners shall set forth in its findings the exceptional situation or conditions that exist and the reasons for the waiver or variance together with the specific finding whv said waiver or variance will not be detrimental to the public health, safety and welfare. Section 5. This resolution and ordinance is hereby declared to be an emergency measure necessary in the interest, and for the promotion of the public health, safety, convenience, peace, comfort, order, and public welfare of said County and of the inhabitants thereof. Section 6. This ordinance shall be published as provided by law and shall take effect and be in force immediately upon publication and shall remain in force from and after the earliest period allowed by law. NVHfREAS, the Millard County Board of County Commissioners have by authority of statute and resolution appointed a Planning Commission for Millard County and authorized them to prepare a master plan for zoning Millard County; and WHEREAS, the committee have undertaken such study and are in the process of adopting a master plan. This resolution and ordinance is in effect for a period of three (3) months and is to assist the planning Commission in directing the growth of the County while such Plans and Ordinances are being drafted.
