| Show TITLE OF COAL LAND IS SUBJECT TO SUIT in t the he CASC case of the unite states stat again against it arthur A sweet the d de e fondant filed his answer with the tle federal court saturday at salt lake city this is an action in equity brought by plaintiff against the defendant to jt f et aside the sale of a certain tract of land by the state to defendant sweet and hav have tho title declared to bo be with the plaintiff the complaint sets up i that hat the land in controversy ia bi cord co land and did not pam paa to alc state by the enabling 9 act bud hence th the state estate had no utie title to the land and could not dispose of it the gist of tho th defendants answer is that the title to the land pur chased by the defend defendant wit was i the state and that through the state land board it had a right to u isell or otherwise dispose pf it and that it was not coal land the defendant alleges in hi 4 answer that theland the land was contracted to be sold by the state land board to george T badger as h lands and that on the yli 41 of december 1900 1906 badger sold fis and unto defendant the lands and all of them and ull sall hh righta rights title and interest in alq to the said lands for a consideration of 2080 that she title to eaid said lands vested in the state etc |
