united states empowering congress to legislate upon the subjects subject of marriage and divorce and bigamy and polygamy resolved by the senate and house bouse of representatives of the me united states of Amer america kain in congress ass assembled ambled two thirds of each houst house concurring therein that the following article be pro proposed P 0 8 ed to the legislatures of at the several states as an amendment to the constitution of the ahe united states which when ratified by three fourths of the said legis laturen la turea shall be valid as sk a part of said constitution namely congress shall have power to legislate upon the subjects ot of marriage and divorce by general gentral laws applicable alike to all the states and te territories tri and neither bigamy nor polygamy shall exist or be permitted within the united states or any place subject to their jurisdiction inthe jn the senate of the united states december 12 7 mr cullom introduced the following joint resolution which was read twi twice e and referred to the comm committee ittes on the tee judiciary JOINT for the amendment ame adment of the constitution of the united states in regard to bigamy aad deemed necessary bythe by the two houses of Co congress neresa to propose an amendment to the constitution which shall be valid to all intents and purposes as ail part of the constitution when r ratified as hereby proposed by the legislatures of three fourths of the several states the amendment hereby proposed tu ti be numbered and to read as follows gowit ARTICLE XVI SECTION 1 the only institution or contract of ma marriage triage within the united li states tates or any place subject to their jurisdiction shall be that of the union in marriage arria e of one man with one woman ceball pass any law nor allow any custom form or cere mony of marriage except in obedience to and conformably com to the institution of of ro marriage arriage as herein defined and established but otherwise the regulation hitun within each state of marriage and divorce and civil and crin criminal kinal jurisdiction over those subjects shall belong to the several states at as hereto lore SEC 3 twice and referred to the committee on territories A BILL to authorize the governor of the teri of utah uta to appoint certain county counts offie officers ers be it enacted by the senate find and souse rouse of representatives of the united states of america in congress assembled that the governor of the territory of utah be and he to is hereby authorized and empowered to appoint selectmen nen clerk recorder assessor and supe rin of district scho schools in and for each and all of the c counties of s aid territory and the term te rm of office of all persons holding such offices a rd nd not so appointed shall cease and i le e termine on the appointment and qua it 1 fl cation of their successors as provida id d in this act SEC 2 all acts and parts of acts in consistent with this act are 1 to constitute the governor and mae awe tary of the territory vt of utah an and d the members of the eteh tah commission a board to reapportion salt lake city into aldermanic and dis districts tricia be it enacted by bv the senate and house of representatives of the voted states of america in congress assembled that thai the governor and and secretary of the territory of utah and the members of the utah commission are hereby con a board of apportionment with full authority to reapportion salt lake city in said territory into aldermanic and districts dietr acts SEC 2 that said board Is author iced and directed to apportion to each municipal precinct or district of said city of salt sal lake ke tile the number of aldermen and councilmen to chica abic each of said municipal precincts or er districts shall be ennit entitled led according to the relative population of each and the voters of each said municipal precincts or districts shall vote only for the number of aldermen and councilmen so apportioned to the respective municipal pree precincts iuchs or districts and no person erson shall devoted be voted boror be eligible for for either of said offices who is not a legal
