Show V Standard-Examine- County must pay costs in old case By MARK PETERSON r staff OGDEN — A 2nd District Court judge awarded more than $3000 to two investigators and a paralegal who performed work for the defense of an Ogden man convicted of murder in a 983 shooting death : The order means Weber County will have to pay the bills for the three men hired by Salt Lake City attorney Ginger Fletcher to whom the county paid $6500 for the defense of Robert Eugene Jones Jr in a 1987 retrial on the murder charge Jones was twice found guilty of the March 11 1983 murder of Ogden resident Kim Chapman — a new boyfriend of a girl he had first-degr- ee 1 broken up with Jones is serving a life sentence atjhe Utah State Prison for the crime His first conviction was overturned by the Utah Supreme Court because of errors in the jury selection process Weber County contracted with Fletcher to handle the second trial because of conflicts with the County public dethen-Web- er fenders Deputy Weber County Attorney Gary Heward said Fletcher should have come to the county or the Weber County Public Defenders Association to hire investigators rather than just going out and hiring “a defense team” “Nothing about his case from the begining has been easy” said 2nd District Court Judge David E Roth The judge said if there was a conflict with the public defenders there would jikely have been a conflict with that group’s investigator But that in any case he said the county’s contract with Fletcher should have been more : explicit “I’m in a poor position to say what wasn’t necessary’’ the judge explained in handing down his ruling He granted a claim placed by Bountiful investigator Edward Barton for $81084 for investigation done on the murder weapon — a handgun He granted a $106016 claim placed by Salt Lake City parale gal Boyd Bryan for his work go- -
