TERRY Chicago Tribune Along with showcasing concerts by standup comedians cable television has a penchant for taking its cameras into the midst of the judicial process Among its exercises has been the mock trial of Lee Harvey Oswald and now comes “HBO Showcase: Waldheim: A Commission of courtroom exInquiry” (tonight at 9) a 3'2-ho- ur amination of the accusations that Kurt Waldheim president of Austria and former of the United Nations was insecretary-genervolved in war crimes as a German army lieutenant in the Balkans from 1942 to 1945 e The participants include more than 30 witnesses — Yugoslavian and Greek civilian prisoners Italian and German combatants Allied and German military historians — as well as an international panel of five judges that includes Shirley Hufstedler onetime US federal judge and former secretary of education The purpose of the exercise says host Morton Dean is not to render guilt or innocence but to determine whether the evidence is sufficient to indicate that the controversial figure should be brought to trial (In February a commission of international historians appointed by the Austrian government found no evidence that Waldheim was guilty of war crimes but stated that he had lied about his wartime past was “in close proximity” to Nazi atrocities and did nothing to stop them) The TV proceedings which obviously have no legal validity have generated a “trial by media” flap drawing opposition even from noted Nazi hunter Simon Wiesenthal There is after all something rather shadily sinister about “playing” courtroom with a living individual who has not been charged with a crime although producer Jack Saltman insists it may be the only fair hearing Waldheim ever gets In the coproduction by HBO and England’s Thames Television edited from more than 40 hours of testimony given in a TV studio outside London over an eight-da- y period in April the case against W'aldhcim is presented by Allan A Ryan Jr formerly the main Nazi tracker for the US Justice Department who begins by saying that though he hasn't come up with a “smoking pistol” he will show that Waldheim was an accomplice to the violation of international laws of al real-lif- war Challenging the allegation is Lord Peter Rawlin-so- n a former British attorney general and Eric e who from the outset makes Sevareid it clear that he is not there to “represent” Waldheim but to probe and challenge the evidence and ward off “the lynching of a reputation" Among the allegations arc those that Waldheim operations variously assigned to transport-suppl- y and intelligence staffs was implicated in war crimes against the civilian populations of Yugoslavia and Greece including the deportation of Greek Jews to death camps and the illegal execution of Allied commandos Aided by maps and film Dean outlines the look-alik- historical perspective as the witnesses some pres- enting evidence for the first time are called to the stand At one point Rawlinson brings on an Italian officer who says that Waldheim came down hard on the indiscriminate killing of prisoners in Yugoslavia Later an army colleague says Waldheim was very critical of the Nazis while others testify that he had no authority to issue commands for the “cleansing operations” (ie reprisals against innocent civilians) Ryan comes back with allegedly incriminating reports initiated by the young lieutenant asserting “His initials were all over the evidence” Some of the witnesses seem to have shown up solely to cover their own behinds After a survivor movingly tells about the massacre of 300 in the Greek village of Komeno by the 1st Mountain Division Ryan tries to pin the atrocity on a Wehrmacht lieutenant colonel and underling Waldheim The colonel predictably not only denies his participation but also claims he never heard of the slaughter Later another German lieutenant declares he didn’t know a thing about the deportation of Jews from Greece Another problem is that many of the witnesses seem like minor players and much of their testimony seems shaky and-o- r irrelevant A onetime British commando describes his brutal treatment in a spartan Greek cell adding that the interrogations were watched by an officer who may have been Waldheim although he never got a clear look Also without the accused himself being present — Waldheim predictably refused to cooperate — the presentation loses much of its drama While fitfully interesting much of the inquiry curiously is dry and perfunctory as the lawyers summon up a barrage of army communications and organizational charts In summing up Ryan says the accusations against Waldheim shouldn’t be dismissed just because he was a lieutenant who was doing his job and he accuses the Austrian leader of “slicing the responsibility into such tiny pieces that no one can be held responsible” Rawlinson counters by stating that his adversary has produced no relevant witnesses or documents derides the “theoretical reconstruction by
