| Show VOUCHERS OF STATE institutions attorney general A C bishop bait bag transmuted to state auditor morgan richards jr an opinion in u answer to the following lowing loJ letter appropriations having been made for the various institutions of the state for maintenance repairs improvements and other specific purposes what kind of authority voucher or order should be presented to lo this office by the respective boards ot of those institutions when applying for state warrants for a portion or all ot of such appropriations here is the reply the law relating to the university of utah provides that the funds appropriated maybe may be drawn quarterly in advance 11 this I 1 take it would be upon the order of the board of regents lor for the state prison the law provides that the auditor must draw a warrant for such sums as the board shall ball from time to lime direct not exceeding at any one time lime the sum of and no lurther further sum aum shall be drawn until satisfactory vouchers are presented to and allowed by the auditor tor for the amount previously drawn in relation tot to the he insane asylum there is no express provision as to when its ita appropriation may be drawn the law provides that the treasurer of the insane asylum shall draw from I 1 the sta shaie e upon the order of the board of I 1 commissioners all moneys appropriated to the use of the asylum and receipt under the bylaws by laws he must make a detailed monthly ing the amount received and disbursed during the preceding mouth month it would appear that in the absence of any express provisions upon these subjects the legislature imposing confidence deuncein in the management of these institutions tut ions extended some latitude and invested invented the board with some discretion in drawing out these funds as the necessities might suggest fugg est in relation to the state slate industrial school ibe provisions are as contained in section 1897 page volume 1 of the compiled laws of 1888 which are not repugnant to the constitution and have not been repealed that the funds appropriated should be drawn out as the same may be needed the appropriation for the deaf dumb and blind institution may be drawn quarterly in advance the state board of equa equalization equalisation salaries are to be paid quinerly qu and the actu actual aland and necessary expenses refunded upon the order ot of the state board of examiners As to the agricultural college Col leee there is in no provision as to the time ot of payment but same must be drawn out on the order of the board of trustees and in the absence of any rule I 1 am inclined to think the appropriation should be drawn at such buch times as you in conr judgment and discretion think necessary there ought to be a uniform rule respecting these theme matter and I 1 would angrest sn infest that th you yon call the attention of the code on mission to the subject in order that coma it i I 1 may come before the legislature at i its next session until then these q ameahr aae creations Reat aHr ions will ill address themselves 7 to yo conr ur good judgment and discretion 1 I have the honor to be your obedient servant J A C BISHOP attorney geu Gei eral ersi |
