tor for a violation of any law A As s to my religious belief I 1 embraced mormonism so called in my early youth my parents being brin believers in its arl sciples aci ples I 1 am and have been for many ln ny years convinced ot its divine origin not from the testimony of others alone bat from a true knowledge my family relations which are one of the tenets ot our laith faith were formed form ed in my iny youthful days warty years ago in good faith believing belie beli vim evini g it to be my duty and between whom and myself there exists the kenderest ten derest and most solemn and sacred relations there have be been en added to them thein a quarter of a hundred bundled children twenty 01 whom are now livin living I 1 have endeavored to teach them to obey tile the laws of their country as well as the laws of god when the bill known 6 as the edmunds bill became a law knowing as I 1 did the government had the power to enforce its laws I 1 took legal advice which was subsequently confirmed fi anle a by the utterance oi of one or two I 1 of the courts of this territory I 1 confined my mantal relations to my second wife and have so lived in good faith until this since which I 1 have lived with neither awaiting the confirmation or rejection of ot your honors decision in the snow case I 1 have not the least feeling towards any member of this court especially tile the grand jury which lound this indictment I 1 believe they reluctantly naLly found it in in the discourse discharge of their duty under your i our honors recent ruling I 1 had bad but little uneasiness when I 1 learned that my family was before them as to tile the results as I 1 understood the meaning and the construction of the law and even volunteered and did go fio before them myself and gave them tee facts in tile the case and I 1 nave have reasons to believe that they would not have so found had it not been for your honors new ruling in the snow case the officers of this court have acted the part of gentlemen toward myself and family when I 1 was wanted they permitted me to goat go at my convenience and tile file my bonds the first man I 1 met on the street was a gentle gentile he proffered pro ered to and did go on my bonds if this statement of facts is worthy of any consideration I 1 shall be pleased to know it I 1 have not tried in any way to defeat tv the ends of justice in this case the court has learned from other persons not of course from ally anything thill 9 that has transpired in the court room but from others as I 1 say eay the facts in your our case to be substantially as you have e stated them as regards your living with but one vi woman oman and that your second wife since the passage of the edmunds act and I 1 shall therefore take this defense into consideration in passing sentence I 1 desire however in order to determine what I 1 should do in your case to inquire of you your mind in regard to the laws of your you r country and whether as a citizen you propose pose in the future to obey the laws of toe the land mr child I 1 have nothing further to say gay your honor in this regard by the court it is a matter of regret mr child that you do not desire to bind yourself by any promise to boey the law or by your speech to influence others to obey the law you tell me you are an american citizen that you have always tried to obey the laws of your country the first duty of a citizen is to obey the law and counsel others to obey the law and every true american should b be e proud and willing to do what he can toward obeying tile the law A man cannot be a a good citizen who is ashamed to sa say he will obey the laws of the land I 1 can only account tor for your course as a prominent citizen in this community anda and a man of intelligence than that you have not net the moral coura courage geto to throw off the alleg allegiance larce you yon have given to a power which sets itself above the government of this country you yon have shown yourself to be not a citizen of the united states but a citizen ot of a power that is believed to be above the government of the nation under that state of facts I 1 cannot suspend sentence in case the time has come in this territory when every man must say he will obey the law with the feeling that exists whenever a man stands in a court of justice as you do today to day it adds just so much to the trouble that thac is already upon the people eople and it will continue until the law faw IS obeyed I 1 recognize that you may have been misled in some degree in regard to the intent of the Edra edmunds finds law and I 1 believe your state statement that you have lived with but one woman and that your second wife but it is the law that a man shall have bave but one wile wife and she his bis first wife with her he must live that is the law it is the spirit of american institutions feeling that you may have been misled I 1 take that into consideration before passing p assin 9 sentence I 1 want to suggest one other thing that you can stand here and say you have obeyed the law as far as you were able and yet you yon say you are unable to promise to obey the law in the f future therefore I 1 cannot suspend sentence I 1 will not be able to take the same course in the future the sentence of the court is that you pay a fine of and the costs of prosecution C ec and that you stand co committed until the fine
