| Show THE CHURCH CASE said mr varian I 1 have the remittitur and mandate of the supreme court of the united states in the case cage known as aa the united states against george romney and others the judgment of this court is modified in this particular cular requiring the court to appoint a master in chancery to hear and determine certain questions in re lation to the disposition of the funds in the hands of the receiver I 1 now ask the court to make that appointment attorney F S richards suggested on behalf of the appellants appe llanto that the making of the appointment be deferred until a future session of the court in order to afford counsel an opportunity port unity to confer together and see whether they could not agree upon some person to act as master in chancery who would be satie satisfactory factory to both sides and acceptable to the bourt this was a matter of some importance mr varian said that should depend to some extent upon the time when the court would adjourn if not till late in the summer or in the fall the appointment should be made at an early date this matter was likely to occupy some time and that was the only reason be had bad for haste the judges conferred and judge zane announced that when the court adjourned it would rould be until september mr richards remarked that even if a master were appointed before that time the there re certainly would be no money tak n until september the court ordered the motion to stand over until three this afternoon ter noon appointment IN THE CHURCH OASES chief justice zane intimated that in the church cases the court would meet at 8 p in and aad appoint a master in chancery any suggestions counsel might wish to make should be made at once mr varian I 1 would suggest the nameon name of judge loofbourow for the position there are a number of gentlemen who are well qualified for the position but for the fact faett that hat they have been connected with the case came in some way or other owing to the protracted li legislation F 8 richards on behalf of the appellant we suggest the name of judge sutherland who has had no connection whatever with the case cam should he not be acceptable we suggest the name of J L rawlins Baw lins who was connected with the case a good while ago but his knowledge of it would be an advantage rather than a disqualification upon the court assembling reassembling re in the evening judge zane said in in the matter of the appointment of a master in chancery in the church suits a majority of the court has decided U upon pon the appointment of judge loofbourow will you draw the order mr varian mr varian replied that he would draw it today the court then took an adjournment until september |
