extend their line of poles on third east street from second to fifth south streets committee on streets L M earl et al asked to have F street graded committee on streets ann patten an aged and infirm person asked for relief from special water assessment referred to the assessor 8 A wilkins asked for cancellation of sprinkling tax on account of in ability to pay committee on sprinkling JL N gregor EXIT BOGUS councilmen the following communication was read hon george M scott mayor salt lake city dear sir the supreme court of this territory having decided that we the undersigned undersigner under signed were not legally elected to fill the seats in the cit city council which we have heretofore held f from 0 the fourth precinct we shall not hereafter appear to occupy I 1 these hese seats in accepted and tle tie following letter was next read SALT LAKE CITY june 16 1891 hon george M scott As the supreme court of the territory of utah in the case of the people vm v louis conn cohn L E hall and W P noble has decided that they were not noi elected as members of the present city Counci land while there was no action in my case I 1 consider the decision applicable and therefore tender my real resignation aaion to take tak e e effect at once and in do doing ri g so wish to tha thank the mayor and members of the ahe cou council neil individually and collectively for the many courtesies extended me as coworkers together respectfully and truly T W ARMSTONG accepted mayor scott the contestants in these cases have filed their bonds and presented their certificates of election and are absent from the territory and his name was not called FROM THE CITY ENGINEER city engineer doremus reported that he had bad made further examination into the question of constructs constructing ft a system of waterworks water works for capitol anti inti hill I 1 and the north bench and recommend ed that the plan previously submitted be carried out councilman anderson anderaon offered a resolution authorizing the mayor to purchase the pipe and that the treasurer be instructed to advertise for the sale of worth of city bonds to be used lor for this work only on motion of councilman james the matter went over until the next regular meeting of the council REFERRED FOR HEARING city At attorney toney hall reported that on account of the rush of business in the third district court the case involving the condemnation of second and third streets from their termini to the reservation vat toti had bad been referred to W tor for hearing adopted WATER city recorder jack reported but one protest against the proposed extension of the water mains along south temple street the assessment was confirmed the same officer reported that no protests bad been filed against the proposed extension of the mains on capitol street S thirteenth east ninth east and fifth south streets the were confirmed K PAVEMENT CONTRACT the board of public works reported that they had entered into a contract with houlahan Hou laban griffith for laying about square feet of brick sidewalk pavement on first and second south streets bei beleen second and eighth east also about square feet of cement sidewalk pavement on south temple between east temple and third west and on first south between second east and fourth west streets houlahan griffith had executed a bond with W S mccornick and A gebhardt gebbardt as securities in the sum of being 51 50 per cent bent of the estimated cost of the work contracted for the committee reported the follow ing abstract of the bids received GRADING was based it upon on the understanding should that they should do the amount of work named in the contract and had purchased the material and tools necea eary to do the full amount of the work called for should there be any considerable sid erable diminution of the amount they would be greatly damaged and they protested against property owners being allowed to let contracts for sidewalks included in the contract councilman lynn offered the following resolution oB concerning this sub eject resolved that all walks already laid and walks contracted for that have been reported to the council to date be excepted from the contract in the sidewalk district no on both sides of second south from second east to eighth east streets and that the board of public works be authorized to accept any pavement which may be laid within any sidewalk district which in their judgment meets the requirements necessary for sidewalk within that district adopted ADVERSE REPORT the committee on irrigation reported adversely on the petition of E M taylor asking to have the boundaries ot the surp surplus lur water canal defined adopted A MOUNTED POLICEMAN the committee on police recommended that the appointment of B R L shannon as a mounted policeman be confirmed adopted AN UNWISE PRECEDENT the committee on license to whom was referred tha peti petition tiou of barnes byrne for a retail liquor license at the worm warm springs recommended that the same be granted mr james Jam esThe the petitioners petition ers in this case entered into a solemn agreement with us that they were to conduct a bathhouse bath house and not a saloon becan we cannot now recede from or modify this contract without stultifying ourselves gentlemen I 1 am opposed to granting liquor license in remote parts of the city where there is substantially no police protection when the petition ers rented the warm springs property they did not ask for a liquor license I 1 do not think they should be allowed a license now on the call of the roll young tuddenham hardy hyde james and spafford voted agai against not the adoption of the report and pinkard Pio kard karrick heath pendleton anderson andersen L lynn nn and parson voted in favor of it abe the vote was declared a tie and mayor scott cast the deciding ballot in favor of the adoption of the report THE JOINT BUILDING excavation the joint building committee recommended that the work of excavating for the foundation of the city and county building be proceeded with at once and that the square squar 0 be properly drained adopted TO HIDE THE HOLE the same committee recommended that Western the bill posting company be allowed to erect a substantial fence aro around u nd the old excavation for the joint building adopted miscellaneous the committee on irrigation to whom was referred the claim of william has kenson and others for 20 for repairing the decker ditch recommended that the petitioners petition ers be allowed 10 also that the supervisor be instructed to construct a flume on I 1 street adopted the bill for an ordinance requiring city prisoners to perform labor when so ordered by the court passing sentence was passed the report of the committee on streets recommended that the west side rapid transit company be allowed to operate steam dummies on first west street was rejected appropriations the following appropriations were made
