Show A VERY GRAVE CHARGE SOON DISPOSED OF john and george chugg the TT IT P conductors who were arrested arr esteil a few laya days ago on the charge of ern em bezz lement were arraigned before justice lainey tuesday dec 2nd and and acquitted there being only the most flimsy evidence against them the accused succeeded by abundant testimony in affirming their good character both men inen have a large laige circle of friends and when they were arrested a profound sensation was created on their discharge they were warmly congratulated by many acquaintances who from the first looked upon them as the victims of pred judice and injustice the prosecuting attorney in the case was P L williams and mr eichnor and judge powers defended the afie accused W H bolett in the employ of the pinkerton detective agency at denver said lie he came out here to investigate the alleged ticket steal lug ing bui business iness on the utah division of the union pacific he made several trips with the defendant between salt lake and ogden and on each occasion chugg failed to cancel several tickets on november 23 the witness rode from ogden to salt lake on a ticket which he purchased in ogden and afterwards he be re purchased that identical ticket from a broker in ogden on cross examination by judge powers it came out that the witness career carcer hid had been a somewhat checkered and varied one 0 B holmes another pinkerton Pinker tou detective employed to work up tip the ticket stealing business said he made nine trips with the defendant between this city and ogden and on every occasion lie he saw chugg take up tickets and fail to cancel them the conductors doctors duc tors Ps method was to have a little piece of cardboard in his hand and he punched these instead of the tickets lie he took up giving the impression that he was cancelling the tickets he purchased a number of trip tickets from brokers here and at ogden after being handled by judge powers afie witness left the stand rather flustered 8 W eccles of the union pacific te testified stifled that it was the duty of a conductor to cancel each ticket immediately upon taking it tilmand up and return all as soon as possible captain lange testified that he made the search at the defend defendants antIs house and found three tickets there he afterwards arrested the defendant when he kr arrived from a trip and brought him to the station boere he be was searched in the presence of a mr adams adam and a large of tickets some of which were was found mr adams testified that the value of the tickets round found on the defendant at the time of his arrest was on cross examination by judge powers however it was elicited from adams that one ticket valued at 40 was in reality void on OB the night of the arrest as was also one valued at 87 zo eo that the value of the ti tic aeta eRets judge powers argued that there was oot not a scintilla of evidence tending to convict the defendant with the sale of tickets to brokers and the mere fact that tickets of the value of 3 or 4 were found on the defendant when he came in on his train was not erina iaal he claimed the discharge of the accused judge laney ordered that the defendant be discharged the prosecution stated that the caia case against george chugg was not as strong as that against J alu and the latter case together with the charge against mrs clugg was dismissed |
