| Show MISS examination two october 2nd and was the hour set for the examination of miss amanda olson charged with the murder of frank 0 hall it was generally known that the grandeury gran grand jury djury began the investigation of the case yesterday afternoon and the expectation was that a preliminary examination would be dispensed with A ac E the hour named the county attorney filed a motion for a continuance till tomorrow supported by an affidavit showing that the grand jury were engaged in investigating the case in support of the motion he stated that time and expense would be saved by leaving the case to be dealt with directly by the grand jury judge powers opposed the motion urging that the defendant was en ditled to ascertain without delay whether or not the offense was to cross examine the witnesses for the prosecution and to have a record made of their testimony justice laney held that it was not proper for this court to take cognizance of what the grand graild jury were doing as their proceedings ce cee edings diDgs were supposed to be secret and that it was not proper to omit a preliminary examination in such a case he overruled the motion for a continuance ti nuance A wait occurred while a stenographer was sent for and then there was another for the appearance of the prisoner at miss olson entered elat ered the court room and alad took a seat beside judge powers she is of petite stature of a slight frail looking form aud her age is given as twenty three she has rather a large but well formed head which is covered with an abundant growth of f brown hair her features are expressive and mobile and her eyes are large blue and beautiful and indicate a tender and affectionate nature the size and form of the nose indicate force of character but the mouth is the feature which most shows determination As she sat down her an expression of marked resolution called up by the ordeal she was facing her demeanor was perfectly calm and composed mrs ann hart was the first witness for the prosecution she is somewhat deaf mr eichnor put ut the th questions to her she tes testified tiRed to having been acquainted with prank frank C hall about two years she detailed the circumstances and particulars of the shooting as they have been made familiar to the public she was on the stand when our report closed and up to that time nothing new dew was learned from her her cross examination by judge powers had not begun under cross examination by judge powers the witness testified that she had lived here eighteen years and was wae a widow her husband having died four years ago for two years fears prior to his death mr hall and his two children boarded with her recently Recent lv the olsons had moved around the corner on sixth street but previous to that they had lived across the street from her the defendant and mr hall became acquainted about two years ago through the witness hall went east in november last and five months ago she went east with the children they all returned to this city and went to the witness house to live the witness continued on the evening of the killing killinger Mr hall and myself left the house at about a quarter past lowers did you have a conversation with miss olson about mr hall sometime before the shooting objected to by the prosecution the court asked the purpose of the question and judge powers replied that he wanted to show that witness was fearful that hall was becoming too intimate with miss olson judge powers when aben amanda olson was coming to your hous edid you no not request her to cease doing so about the relative positions of witness defendant and hall when the shot was fired and the witness was excused dr meacham te testified stifled 1 I first saw the body monday evening in the patrol wagon and next morning made an examination the witness here described in detail the wound which caused death the rhe ball entered the left side of the head about three inches above and in a vertical line with the auditory opening and passed in a straight line through the leit half of the brain grazing the top of the right half death was due to hemorrhage caused by the wound ro fo judge powers the hamilton and came back with him in about eight minutes he said the man was dead before starting I 1 asked some one to telephone for the patrol wagon mrs hart seemed to have most to hayand I 1 told objected to the court the evidence improper imp rooer witness testified further I 1 did not nob hear the shot fired should judge I 1 was on the ground about two minutes after the shooting mrs hart said to mr olson your daughter shot him she stood right behind that tree there mrs hart stood holding halls hat of the police office last monday evening at about defendant came into the office a accompanied com by a young man and said she to give herself ud up she handed me a pistol and a letter which I 1 handed to marshal young am not positive as to the words she used but she said she hvid had shot some one in the private office she made a statement part of which I 1 heard to judge powers do not know the name nor the business of the young man who came with defendant know him by sight eight deac described bribed him he said that defendant had bad come up to him and asked him to accompany her to city hall did not take his name nor address do not know where he went supposed he went away with the p patrol atrol wagon mr eichnor here remarked that thai the prosecution had tried very hard to find that young man but bad failed marshal young te testified stifled I 1 have known amanda olson since kance she was a little girl on monday night she came into the police station gave a gun to officer mccurdy and a letter to judge laney and said 1 I have shot my betrayer she was then taken into my office where she walked the floor in an agitated manner mander I 1 officer lang testified to the same facts the Theo prosecution had no further testimony and judge powers stated that the defense would oner offer no evidence dc dee mr eichnor then briefly reviewed the evidence claiming that it showed that a murder had been committed by the delen defendant daut and lie he asked that she bo be held belt to await the action of the grand jury without bail judge powers said that as the grand jury would rl turn an indictment this morning he would not oppose the motion and the order was accordingly made contrary to expectation the grand jury did not report an indictment of miss olson today and as the district court adjourned until 10 ain monday there will be no opportunity anity to do so till then it is surmised that there has been a prolonged debate in the grand jury alu room on the question of finding an indictment though lawyers hold that that body has no alternative it has the right however to determine the degree in which the offense f shall be charged and it if jg is hinted that it is upon this point the inquisitors inqui are divided all this is mere surmise however |
