hatch J H molton 39 WEBER COUNTY this was the last county on the list and was reached shortly before 1 p m earlier than the board had anticipated mr hiles was present resent and on behalf of mr D din DAD in hamer er he stated to the board that he proposed to ask the district court for a writ of mandate requiring the board to canvass the ballots and not accept the face of the returns he said that it the board would accept it judge loofborough would defend the action of the bord bo rd he did not anticipate any different action on the part of the canvassers but took this step to preserve the rights of hla his client allen the board accepted the proposition for judge loofborough rough to take up the issue in this case cam the canvass of the returns was then commenced and w when hen poll 2 second precinct ogden was reached the nine votes returned by the judges of election as having been cast on liberal tickets for mr hamer for county clerk but not counted for him by the judges were placed to his credit the returns frum from weber county were then canvassed with the following result but were not certified to pending the action suggested by mr riles hiles collector albern mien il COSTY SALT SAIP SA IP LAKE the matter of the salt lake county election was taken up judge judd moved that arthur brown and J L rawlins ballins represent the board in the action brought against it by col page this was carried mr An anderson deroon and col sells voting in the negative col sells read the answer of himself and mr anderson andersen stating that they would make no BO defense as agreed with the position taken by col pages pagers attorneys atter neya it was decided to take up poll 3 precinct 2 and bluff dale involving the count for treasurer be taken up and the ballot boxes were sent for the board of canvassers then adjourned till august 27 at 10 am the board of canvassers held a brief session on august 27 but it was one of anxiety to the interested bartles part les the occasion of this was the recount of poll pod 3 Prie precinct 2 of the cast for foe treasurer owing to a discrepancy between the judges Judge list and the abstract w col stone on behalf of mr Gallig galigher ber objected to the ballots being counted he wanted the result as shown on the face of the returns to be declared thus leaving a tie and no attention PRU to the the evident mistake of the judges of election His objection was overruled and the ballot box was opened the votes taken out and Cb chairman airman sells took up each ballets ballet reading the name of each candidate condi date voted for judge jude smith and mr anderson kept the ta tally sheets the ballot was passed to judge judd and then to mr alte both of whom examined it at the outset there were 70 straight votes for toronto then came for galligher then two for toronto two for kalligher and four for toronto thy definitely proved that the abstract signed by the judges of election contained an error one ballot had no candidate for k treasurer by a comparison with the total num number berof of votes credited to the candi candidates dalp four baj ballots lots were d discovered Is to lie be missing from the ballot box A further comparison showed that three of these were Gallig bers and one To mr brown we demand that the presiding judge who had the custody of that box be brought in who was it col sells it was J W skinner judge smith hore here is the tally sheet that the judges failed to send in it shows 77 fur for feronto fo ro the other tally sheet shows 77 but is counted as only 71 on the abstract col stone it will be a contested election C E allen alien it may be the other side that took the ballots mr brown no difference the ballots are gone and somebody should be made to account for it judge galligher anto 76 the count of the judg lf election was galligher toronto 77 this gives toronto two votes more than allighen alli gher for the office of treasurer of salt lake county there was considerable excitement among the attorneys and candidates in attendance when the result was announced and the judges were severely condemned for the blundering way in which they had done the work the abstracts and tally sheets showed a total of votes cast while but ballots ballot 4 were found in the box the returns were then footed up for all the candidates except those for recorder the figures being the same as those published in the news with the exception of the change made in the poll counted today where toronto was given the ma majority 11 arity instead of a tie the e board signed the application for a writ of mandate directing the board t to count the ballots in certain precincts at ogden was denied the weber county returns were certified to the board of canvassers having completed all but the count for recorder in salt lake county which is to be considered in court august adjourned to meet at the call of the chairman in the district court of the third judicial constituting board of can now come the said defendants the board of canvassers at the county lection election e held august 4 1890 and answer the alternative writ of mandamus served in this case and the said board alleges that each of the members of the said board was duly appointed and qualified as a member of said board of canvassers of salt lake county and all the other counties of said territory and aad as such they proceeded to canvass the votes of the several precincts of salt lake county containing 41 polls that among other polls was found by the said board the return from poll no mo 1 of precinct no 1 salt lake county utah for said election in cartiff certified ed copy of which is annexed to the answer in this case and to which this board in this return and answer refer and make it a part of their answer anaw er that upon examining said return the board found it to contain a discrepancy between that return and the other returns from the various precincts in salt lake county from the other returns it appeared that the vote for county recorder was tor for henry page and for john H rumel jr and not for H page nor for ajohn john H rumel nor for J H rumel that in the opinion of this board the variance between these different polls and precincts stated constituted a discrepancy or irregularity affecting the result of the election for the said office aud and of each of the said candidates that the number of votes cast in the said poll of Pre precinct cinet no 1 was such duch as to affect the result of the election of said candidate and therefore in the I 1 judgment ud graant 0 of said board of canvassers it was voted to examine the ballot boxes of said sa id poll and said bald precinct and such other ballot boxes as the returns show contain similar discrepancies that the returns of the ither precincts referred to in the said alternative writ of mandamus mon damus are an and made a part of this answer and the same discrepancy exists in east mill creek and butler precincts that the board had bad not yet determined ter mined whether they would or would not open the ballot boxes of the said other two precincts this board further return that one of their number J W judd incorporated his views in an opinion filed with the said board which by way of answer in his behalf and in behalf of a majority of the BJ added and appended to this and made a part hereof that flitt said majority of the board based their aution action upon the opinion tw filed a and the board further ans s return that they had not bob i plated the canvass of said salt lake
