Show TAKING TESTIMONY further arther examination of witnesses in the church case As stated in last evenings NEWS mr james jack was called allied yesterday day afternoon as a witness in ift the suit of the united states for church proper he testified in substance as follows 1 I 1 did not n negotiate with francis armstrong for the purchase of the street railway stock after the negotiations were corn com plated 01 I 1 told him he could have the stock the correspondence between mr armstrong and mr taylor was carried on through me or at least a portion of it I 1 took his note for the amount I 1 could not tell you the exact date of the note from memory I 1 did not act as john taylors agent in selling toe the stock I 1 nave none of that correspondence pow mow and it is some time since I 1 saw any of it it was waa towards the last of february aary when I 1 first rede received ived intimation that the stock was to be transferred to mr armstrong it was between the of february and the ot ol march do not remember who told me that th the stock estock was to be transferred to armstrong the transfer was made in the street railway office in the church office mr armstrongs testimony was to the effect that the note not was but bat I 1 had bad it in my mind that it was ho hc however shou should ad know kaow most about it the note was vas d due e 12 months from date I 1 acted as clerk tor for join john taylor until his bis death I 1 put the note in mr taylors malls mail which was deposited in a box in the back office I 1 think I 1 mailed other notes that day to I 1 cant be positive whether it was the same day ide I 1 de posited the notes of the salt lake dra matic association they amounted to to the best beat of my recollection there ther ewas was also another note that of john C cutler given for provo manufacturing fac turing gos cos stock for dont know anything about the sale of sheep to mr armstrong he did not give ae me a note tor for and no fia negotiations were carried on through me for their purchase it he said so he be was certainly mistaken the trustee in trust owned over 1000 shares in ia the provo manufacturing association shares were sold to john C cutler on his hie note there was no collateral security to the best beat of my recollection I 1 presume the note was made pay able to the trustee i ia trust know nothing about th tho 3 sale of any real es ea tate fate I 1 L never understood that the property next north of Z C M R I 1 was held by joseph ji smith as p property erty during the years 1884 1885 I 1 1886 an and up to the transfer in 1887 it 1886 the trustee in trust held shares in Z C M I 1 which was worth in the aggregate do not know keow the exact date when the stock was dis posed of it was sold to H J geant co 0 o they paid lor for it in caan as I 1 unde stand it for eighty per cent could not lell if it just jast when the sale was made the trustee in trust had bad none of that mony on hand baad in march 1887 the church did not do any banking could you from memory where the money received on the of Z C M 1 I stock went to some of it was used to pay the hands bands on the public works on the temple etc there was a large amount stan standing ling to their credit on the books but I 1 do not know how bow much it was it would b be mere guess work tor for me to sa say 1 I do n not t think the payments for tak abe Z C M K 1 I stock were all made at once but I 1 think we got the entire amount within a month just before the law dis incorporating the church went into effect I 1 received a power of attorney from mr mr taylor to assign certain personal ato property erty to the different stakes I 1 think that wan wag on the of february I 1 bad no personal knowledge of any of the property so transferred d the assignment in each case was made by telegraph or letter it was made by telegraph where there happened to be an office and by letter where there was not this closed the proceeding edine for the day A further hearing will be had tomorrow |
