| Show THE NEW JURY BILL the following H F no 9 a substitute bill for the selection and payment of jurors introduced by representative Ee th thurman urman hasy hasT assed both branches of the legislature and has been sent to the governor for his approval SECTION 1 be tt enacted by the governor and la 11 legislative assembly of the territory of utah tah that in the month of april A D 1886 and ann annually thereafter in the month of january the clerk of the district court in in each judicial district and the probate judge of the county in which the district court is next to be held shall in addition to the number of jurors already provided for by law alternately select the name of a male citizen of the united states possessing the qualifications of jurors as required by law and as selected the name and resi residence denee of such shall be enten entered d upon the list r until the same shall contain two hundred names when the same snail shall be duly certified certified by each clerk and probate judge seca 2 the clerk of the district C court shall write the name of each p person upon said list so returned and tiled in his bis office upon a separate slip ot of paper as nearly cs as practicable of the same size and form and ail such slips shall by the clerk in open court be placed laced in a covered box separate an and bex distinct from the box containing cont cout aning the names already provided for by law and shall be thoroughly mixed and ana mingled SEC 3 the box containing the names ot of jurors heretofore provided for by law shall be legibly marked in a distinguishing 0 manner and lor for all purposes shall be known and designated as the original box bos and the box containing tile the names of the jurors provided I tor ar in this act shall be legibly marked in a distinguishing manner and for all purposes shall be known and as the supplemental box SEC 4 whenever in the proceedings of the district court all the names of the jurors in the original box shall have been duly and regularly drawn I 1 and said box shall have become corn com pleddy exhausted it if for th purpose of any trial or term of court the united states marshal or his bis deputy snail proceed to fairly draw by lot from the I 1 supple supplemental mental box such number of namis as may haye have been previously on iv ordered by the judge or as i may b be necessary ju essary for the trial pending pro aided vided i da that I 1 if at any time in the regular proceedings of the court all the names of the jurors lathe in the supplemental box shall have been duly and regularly drawn and said box shall have become completely exhausted it shall be tb the duty of the judge to direct the District i court clerk and probate judge jag d e to proceed at once and alternately ria ely select the name of a qualified male citizen as hereinbefore provided until the list shall contain the number ordered by the judge SEC 5 jurors shall not be selected or drawn or permitted tol serve in any baue bakie in the district courts of this territory except as provided in this act and in the act of congress entitled an act in relation to courts and judicial officers in tho the territory of utah approved june 1874 SEC 6 until the lant day of april A D 1888 jurors aurora selected and drawn in the district district courts of this Terri territory tor as provided in this act or in the act 01 of congress referred to shall be paid the sum cofone and one half dollars per day for each days actual attendance aucourt and fifteen cents per mile one way for the distance necessarily traveled from the place lace of summons to the place of holting holding court SEC 7 the clerk of the district cout court shall whenever a juror is discharged issue to him a certificate under onder the seal of the court stating the name of the juror and when and where summoned the number of miles necessarily essa rily traveled from the place where service of summons was made to the place of holding court and the number numb er of days said 11 furor uror was in actual attendance SEC sac 8 upon presentation of said certificate 0 the auditor of public accounts he shall forthwith audit the same by comparing it with the statement of the clerk provided for in suction denof this act and if found correct and the appropriation herein has not been ex austed he shall issue his warrant for the proper amount such carrut shall be redeemed whenever presented presen for payment at the territorial Trek treasury sary out of any moneys appropriated for that purpose SEC 9 the plaintiff in each civil action and the appellant in ia each civil case appealed to the district court shall respectively before his complaint is filed or his 1 appeal is docketed deposit with the clerk of said court the sum aum of live five dollars which shall be known and design designated designates atea as the jury fund provided that the ilie term civil action in this section shall apply to and include all actions where a municipal corporation po ration is a beneficially interested provided further that in case judgment is rendered in favor of such plaintiff or appellant aalde amount may be be taxed as costs and collected as other costs in the action SEC 10 the said clerk shall within wiehl n ten days after the close of each term of the district court furnish the territorial auditor of public accounts a statement in writing showing the name of each juror in atten attendance daice during the said term of court when and where he was summoned the number of miles necessarily traveled from the place where the service of the tha summons was made to the place of holding court and the number of days said juror was in actual attendance SEC 11 the said clerk shall on or before the first monday la in june 1886 and aad quarterly thereafter pay inta the territorial treasury T all sums butas of money deposited with him under the provisions of this act less his tees lees as required hereinafter provided and shall at the same sam time furnish the territorial auditor of public accounts a written statement showing the number of cases filed and appeals docketed since making his last statement and the title of each case and the auditor of public accounts is hereby required to me file and preserve in his office all state I 1 ments required under the provisions of this act SEC 12 the clerk shall receive for his services ts herein required ten per r cent of the jury fund anti and such forager farther compensation for selecting jurors and preparing jury lists as is allowed ifor for similar service under existing laws SEC 13 that the sum of dollars for the year 1886 and the sum of dollars for the year 1887 or a so 0 much thereof as may be necessary is hereby appropriated for the payment of jurors under this let act SEC 14 this act shall be in force from and after april 1886 and until it expires by the limitation herein pro aided vided |
