indictment in the case of william kimball jointly indicted with several other persons for the murder of buck in september 1857 was wad commenced in the third district court t before judge mckean this morning mornings the art of framing an indictment so as to stand legal test and scrutiny seems to be a very difficult one and in the present instance this indictment for murder in the first degree am according to the statement ot of defend defendants anea anVa counsel ia is singularly and tally fatally fh defective in ordinary cases the omissions which are ane said bald to render it xo ai might not be BO so remarkable but in this ease case casen in which most of the tha parties defendants cants saTo sate aro are mormons cormons Mor mons and one of them president young toung himself one would have imagined that the worthies whose business it is to frame fratoe indictments who have expressed and on every publio public occasion take the 11 berty liberty to express the most ev olence and vindictiveness against everything mormon it I 1 is strange passing strange that any omission aich would jeopardize the validity of the instrument should have been made and it can only be accounted for on the hypothesis of the utter and complete absence of all data to frame a valid one the grounds of the motion of the defendants a counsel to quash areas are as follows first that the said indictment purports to charge the crime of murder against the said sald defendants under the statute of said territory yet the grand jury in the margin thereof have designated the degree 0 I 1 to wit murder in the first degree second that there is no addition or description crip tion therein of this defendant or of either of his co eg defendants third that asid indictment is vague indefinite and uncertain in this 1 t th the date ot of the alleged offense offence is nowhere therein laid with certainty but the same samo is laid undera andera vid elicit 2nd and there ia Is no allegation therein that the deceased was a livin living human being weing at the time of the ali sli alleged erea ered assault and homicide ard 3rd that it does not appear whether the said buck if killed at all was killed by the tho baid said william A hickman with a pistol or by the saia said morris meach am with a knife fourth there is no allegation therein that tiia t a any by or all of the defendants conspired together r or that this defendant or either of the saia said defendants except only only the said william A hickman and the said morris was or were present aiding or abetting or was wag or were accessories before the fact of compassing the death of said buck or was or were otherwise unlawfully connected with said homicide but on the contrary it appears affirmatively from said taid indictment that the said homicide was committed by either elther the said hickman or the said meacham and not by the other defendants fend ants herein impleaded pleaded im or either of them fifth the said indictment is otherwise uncertain thin and indefinite particularly in this chatin that in one coundit count it alleges a murderous assault and wounding first by said Hickman with a pistol ana an secondly b by said meacham with a knife and the dea death tk of said mid buck byre byro ason eason of said wounds sixth ath ere is no allegation of malice af aforethought oretho or otherwise on the part of this defendant william kimball or either of his said co defendants except only the said hickman and the said meacham seventh there is no allegation that the i leaden leadon bullets wit with IL which said wounds are alleged to have been inflicted were discharged out of the pistol in the hands of said hickman without which it is impossible that the said buck was wounded as set forth in said indictment eighth that baid eaid indictment was found by the grand jury without the testimony of any sworn orn witness or 01 witnesses as appears there being the names of no witness or witnesses endorsed thereon as required by law or if found on the testimony of witnesses their names are not endorsed thereon the several points vero were argued by mr hempstead eminent law authorities being quoted to support hig his position as far as time would allow until the midday mid mia i id day ad journ ment of court the argument was resumed this afternoon mr miner participating we believe for the defence to be followed of course by the prosecuting attorney and the ass pros att the decision of the court in this case will be awaited with more than ordinary interest and there is little doubt will sustain the
