under signed members of the grand jury tor for the september term of this court courts in concluding their labors respectfully submit herewith the reports of special committees mit tees teeb duly appointed from among their number to inspect the prisons and lusane insane asylum in said district together with this general report aa as adopted in committee e 0 the whole commencing with the impanel ing of the grand jury on the lat day of last october ye We have dur ing our sessions ending this day of november novembers 1879 had presented sen ted to us ug the tho names of nearly persons charl charged ed with violations of tho iho laws of t the he united states and the laws of the territory ory of utah of this number about 50 have been indicted in this thib connection the undersign ed members of the grand jury juny wish to say that ing InI cases presented to them thern of persons charged with crime under the mw jaw of congress of 1662 1862 against polygamy they have found great difficulty in obtaining con sistena truthful testimony from some witnesses who from their own admissions and from the circumstances cum stances in which they were p placed laced it would seem could if it the they y w would ouid have easily satisfied us as to the guilt or in nocenza of the parties charged with bald said with some exi in the cases allu aliu alluded dett to i the witnesses were either unwilling or unreliable especially was wag true of some of the persons persona appearing before us and ana the under undersigned signed members of the grand J ry desire in view of thet painful exhibition of disregard for the sanctity of judicial oaths in coni action with this clas cias cla cia s of offenses to place upon record the expression pr ossion of their opinion it is the constitutional right of every citizen to have hawe a speedy trial in the courts in all issues involving his life liberty and property As means to this end our laws jaws should provide ample opportunity for the paneling em of juries and for the fair and onest honest ti compensation of both jurors and witnesses we respectfully submit that here in ittai the courts are ale cripple dand the tho people aufner buffer by reason of defective laws in these respects on the opening of the present term terni af bf this court th there ere were on the trial calendar civil cases of which 82 cases fiade have been disposed 3 of together with 18 criminal cases casee of the remaining ill civil cases over are for trial jury but the limited number of juryman jurymen allowed to be drawn is already exhausted to such an extent that the court cannot proceed with trials As a result of this delay interests of great magnitude are jeopardized under our inflexible laws lawla no tal esmen can be summoned to supply tb the deficiency ifju af jury juny ry men only a limited number can be selected from two well defined de filed and in some respects rt hostile clas olas classes ses kes when this insufficient number is exhausted j judicial pro ce edings in jury cases are at an end this grand jury respectfully is U umit thal thai immediate action on the part of congress is needed to project prote ct and secure the rights of in utah co to a trial by jury either by enlarging the number ot or drawn un under der the law as jurymen juryman jury men or by authorizing au the court to summon tal tai eimen esmen to put injuries on juries with regard to the compensation ul t jurors and witnesses tor lor travel and attendance upon the court we are warranted in the assertion that the present system la in its ita practical working is simply a legalized robbery tery Tr the tho territorial statutes brov provide lda ida that a definite sum shall shmil be paid for mileage and per diem them to I 1 jurors arois and witnesses but our legislators have carefully against ga irist trist thib thit unfortunate class clasa ef of public servants providing that said mileage and per dieg diem shall not b be Q audited and paid until an appropriation pria tion lo 10 made expressly for that but the appropriation on etien amade amado made vearly learly nearly two years yeara sago agu ago asto small that sut aub justice was nol not nol aud and jursits and witnesses in consequence tola grandeury gran grand djury jury for fur themselves and in behalf of injured furors jurors and against thia thid injustice and respectfully ask redress or of this grievance at the hands of our legislative assembly it appears that papers records of the third district court at sait gait t lake city are now exposed exposed to loss lose by nire fire theft and mutilation this jury would respectfully recommend that provision be made by the legislative assembly of utah for properly recording bald said and documents an asylum and it is badly sadly out of repair in many places making it cold cola and uncomfortable your committee found tho the following named inmates kept in cells or stables that were unfit for a beast an and d the stench and filth must soon end the days of the inmates unless a change la Is made hugh lyons victor marose miller and andrew stevens Bt evens these those men have the poorest thorr tio nand alad iwhite while they may be somewhat violent could be cared for in a more humane manner your committee would recommend that repairs be made upon the building at once BO so BS as to insure the comfort ot of the inmates against cold and inclement weather and particularly in the part in which above named persona a are re confined the and now your committee would invoke the aid of the
