| Show SENT seny SE NT TO TIIE THE penitentiary alm AIM MISS starkey REFUSES TO ANSWER THE QUESTIONS OF THE GRAND i juny JURY at about 4 yesterday afternoon af ter ler ulsa misa elizabeth A starkey starley was brou brought va 1 11 into i to the district court room rooth and hn 1 1 mediately 1 afterward the grand grana J jury luny u ry filed tiled iu in and were seated the loreman foreman handed to the court the following report to the honorable the district court of utah territory the grand rand jury of the above entitled court duly paneled em and sworn for the april term ism isu thereof respectfully report that there is koiv pending in before said grand jury an in investigation atlon of the charge against one bone chas L E white accused of the crimes of polygamy andoe unlawful cohabitation thad thai testimony nas baa been introduced tending to show that the said chas L white ild tid did lid marry and take to wife one margaret hamilton between six and seven years since and that the said margaret hamilton then became and was his lawful wife and that she is still aill alive and after the introduction of such testimony one onn elizabeth ann starkey was called ond and sworn as a witness in said matter before said grand jury whereupon the following questions were propounded to sad ad witness are you married to charles lillef LAV hf c have you at any time within ve vears a i last past at the county cl cf sal salt lake la e in the territory of utah gor through ugh any marriage ceremony v r charles L white have you been married to charles L white within kittila three years and this county iut but to answer the said questions 0 either of them the said elizabeth ann starkey refuses and declines and still does refuse and decline so to do 10 wherefore the grand jurors aforesaid rn respectfully request this honorable courato court to advise and instruct said witness whom they now produce before the court whether or not she is in duty bound to answer said questions or not or either cither of them C E foreman Uran grand dJury jury the court after reading the report informed the witness that it considered the questions proper and that it was her duty to answer them the jury were told that they thy could retire and receive the witness answer miss starkey stated to the Court th that t there was no necessity tor for this as she h did not propose to answer any of the quest questions lons ions at this declaration the court said that a witness could not defy the lav law that I 1 it 1 did not desire to send her to tiie the penitentiary and remarked but but bat if QU ou still reluse to answer these fuesz ques eions you will go there aha ahi stay there too for some time lime miss aliss starkey repeated her declination and was ivas ordered to be committed to the custody of tho the marshal until she should answer or be released by bg tile the court to the inquiry of the judge as to whither she sha had been advise advised by air white or any one else to take tile the course she had followed the witness replied that she had not but acted of her own free will she was then taken to the penitentiary |
