witness elles ellebr sister of anna was the next witness I 1 know kaow the den defendant dant I 1 have always lived with mth my mother mot herlit Sit is four five or six years since defendant def enfant commenced to my sister I 1 dont know how long iong it was wag before I 1 te testified stilled before the grand jury fry that they marr married Jed I 1 should think about three years I 1 heard hear my mother balki talking nf about that marriage mair lage that is the way I 1 found it out I 1 dont know now long it t was after her marri marriage ake that my sister went to connellys connellis Con nellys store say it was a year say it was three mouths di dont bult knobf mrs sarah gallifant was recalled and asked to produce a certain memorandum la in which she said yesterday she putdown put pat down the date of her daughters in marriage arria she agreed to go home und and look forie forio for fon it t and during her absence the court took a recess from 4 to a quarter to five when she slid returned and announced that her search had been unsuccessful it was an old book she said and might have been destroyed t ELLEN GALLIFANT recalled mr dickson read from the grand jury minutes dont wink it is three years aw ago donte think it was two think it may have been one year he then asked the witness are not those your statements before the grand lury luny I 1 A avint t dont think that they are swear if I 1 did say that I 1 was mistaken and worried by the lawyer er have not talked either wih wiil de lend lenfant len ien dant ant aut my sister my mother orl or any one els eis else eise e about abbat my evidence was never told that I 1 had better betten not come heere heire ller iler bernard I 1 iama lama am a brother to annie gallifant haye have known the defendant ten or twelve years I 1 I 1 think mys my sister lster ceased to live at my mothers house in the fali fail of 1 ja or spring of yso 80 could nIX say positively I 1 knew of her living away frem ho home before 1882 my mother told raa rae of the marriage I 1 did not like it much I 1 never uever spoke to the defendant about it i thomas H oward howard and eber case in turn testified but nothing material was wa brought out from them the court then thea adjourned tIll thIs in morning Tr friday Iday oct 31 10 a in the forenoon of today to day was use used d up mostly in ln an endeavor boythe oythe prosecution to impeach the veracity of 0 those witnesses who have testified that john connelly and annie gallifant were married in 1879 the object of this is evident for unless the prosecution can prove that their own witnesses have sworn falsely the polygamous marriage is barred ed by tile the statute of limitations the indictment having been found three years after the marriage is alleged by these witnesses to have lacave taken place the first witness called was vas DAVID who I 1 have a sister named annie gallifant ballif ant have known the defendant two or three years have been told of annies In marriage arriage but not in his bis presence nor by him dont know when she went to live at his his bis store she has been belan working there several years year dont know what time she he left mothers mother s house I 1 was married march 1882 1883 and moved moved away I 1 think annie had hwd left there before I 1 heard of the defendants being indicted but dont know how ion lon long iong before besore that she went to live at the store I 1 got back from montana a year before I 1 was married I 1 saw the defendant at the house then dont remember his being there belor becore I 1 went to montana blon bion tana cross examined dont remember when the store was built MRS sarali SARAH gallifant recalled Ee called my daughter annie was married to the defendant in 1879 she lived with me about two years before she went to live at the store they did not live together while she was at my house that I 1 know of I 1 think it was in 1882 that she went to live at the store before she was a member of my family but did needlework needle needie work at con nellys sometimes dont know how long iong she worked at the store before going to live there I 1 dont think it was a year I 1 think the memorandum I 1 spoke of yesterday is destroyed I 1 just wrote it down in an old book so I 1 could remember it I 1 wrote down the year and dont remember the month I 1 might have said yesterday I 1 thought it was Hebr february uary but dut my memory is poor I 1 was tou told of the ta marriage arriage a month or six weeks after it took place I 1 wrote the memorandum with a pencil witness was asked to rewrite re write the entry on a piece of paper to the best of her recollection she sald she could not see to write without her glasses some were borrowed for her she the theu then wrote annie was married the yearl 1879 11 she continued I 1 not whom she was married it was an un 1 finished entry I 1 write very little annie generally ene rally raily wrote my letters fetters it was a a nie cie little brown memorandum book of ruled i paper three or four inches wide there was only one entry in it ellen tellen gallifant was here sent after h her er mothers glasses that she might see to write the entry plainer witness some Someone one was presen present tat at the time I 1 wrote it I 1 dont remember who mr rawlins here objected to this questioning as immaterial per r and handmade made a ringing little speech the vh e prosecution he said had bad had bad unlimited license in recalling and anspro ro bing this witness with all sorts of oi irrelevant questions and it had now i reached a point where he thought the court should interfere mr nir dickson replied that the witness was hostile and they hai hal the right to uncover a fraud if it existed lie he did not believe belleve the statement of these witnesses regarding the date of this marriage february 1819 1879 and he had the right to question their veracity and endeavor to impeach IT mr ilaw Itaw hins fins the prosecution have conceded that they have not the night right the their Irown own witnesses all this bid badgering gering aa asto to what took place in the absence of the defendant is imma aerial and improper asto As to counsels opinion about the date of this marriage that has nothing to do with the trie matter it Is an unauthorized injected into the belly of his argument a stump speech to influence the jury let my client be convicted if at all within the rules of evidence and not by anch unauthorized procedure ufe afe as this mr dickson replied to this vigorous speech which we give but very imperfectly in a moderate and more humble vein and the court then allowed the witness to be still further probed in the interest of lus jus justice lyce ilee 11 exception by the defense witness I 1 simply scribbled it down 1 I think in the presence of one ot of my children but I 1 dont know which one intending to do it properly afterwards in a better book and remark 1 ea eda that I 1 would do so MISS sarali sarau gallifant GALLIVANT I 1 am sister to annie Galli gallifant fant faut have always lived with my mother 5 annie is 23 years old I 1 am 25 it was two or three that annie I 1 left eft home ho me icamen I 1 came to the city about 12 years a ago 0 O I 1 got acquainted with defendant soon after he visited at our house but did didt not seem more devoted to annie than to me never heard him him say nor her in his presence that they were married I 1 heard ol of the manian before she went to live at the store 1 I 1 think in 1879 the witness became frightened through the badgering of the tio tlona tiona nand nd answered at random lor lon for a few moments saying 1872 then 18 1879 9 but bu ton on regaining herself said she meant 1879 a and aud td not 1882 continued I 1 could not hot say how long before the indictment was ivas found I 1 wag was was in the habit of visiting my sister atthe store my sister wis was condoned with her child in november 1882 1 I think I 1 remember the miles ulles trial was acquainted with the defel defendant before that he had always been friendly with the family famely fam lly liy cross the store had not lit very long when my sister went to live there I 1 think it was the summer of 1882 2 she went there to live the defendant has visited us since 1872 and always been friendly annie bad been in the ahe habit of going to defendants house long iong before tha store was completed he visited us that time it was perhaps two or three years before she went to live at th the e store my sister was summoned before the grand lury iury a few days before the birti of her child she was imprisoned or a day and a half and the child was bora two or three days after that my sister first had rooms above the store then back of thet th store estore it might have been the spring or summer of 1882 that she went there to lo live Redl redi redirect do you remember defendant living in anchouse any house before the store was built witness 1 I 1 believe he lived in the same sam house with us but in a different part at one time cannot say how long annae annle annie worked in the store before she lived there it might have been two or three years I 1 dont know she may have worked there up to the time she went before the grand jury when she did work at the store stor eShe she ghe generally came home nights r she went to sew at mrs golightly home dont know of defendant and my sister living too together ether ethen before she went to live at the store BISHOPE P F lEETS Sl I 1 have been bishop of the eighth ward over 25 years have known szn john connelly for more than tive five years th the defendant was on a mission a few year years ago 1 IL 1 remember the miles trial could not say that he went before or after that nor how long he was absent it was a short mission within a year perhaps cannot say when he went or returned dont recollect whether he was here during the miles niiles trial or not I 1 have not been absent any great len ien length h of time in the last five years no ro longer ner n er than a month or two at it a time my counselors would officiate in my absence the they are joseph mcmurrin and isaac isaac isaae Drock prock brockbank bank the defendant to my rl recollection collection never applied to me tor a permit to marry I 1 saw annie gallifant perhaps three or four years ears ago the first time I 1 saw her iu in connellys connellis Con nellys sto store stone rethen then i did not 1 know of her marriage to the defendant never heard him say an any thing about it to m my a permit to mar marry doia would be in writing or bermit in print I 1 do not sleep keep any record of permits they are generally written I 1 never makenny ma keany report to the church of marriage permits issued in in my wom ward a permit or recommend would be sent to the endowment house it would first be addressed to the president of the stake angus M mcannon cannon is now the president prior to him I 1 think george B wallace acted this would cover the past four or nive five years cross I 1 remember connellys connellis Con nellys brick store being erected but dont remember the year mrs hirs saran sarali GALLIFANT was recalled and having received her own glasses wrote once more the entry she remembered to have made of her daughters marriage it read annie was married the year 1879 1 this was offered in evidence by the prosecution the poor penmanship as an impeachment of her veracity that she made a memorandum that is that it was improbable she ever made it cross the store was erected I 1 think in 1882 1 I think it was less than a year that defendant was absent on his bis mission know the year I 1 cannot say whether it was october 1878 that he returned redirect i it was after he returned that he married my daughter I 1 may have said before that it was af after ter 1879 he returned I 1 could not state the time positively I 1 have no conception of how long it was |
