mineral only a small i portion is so in reality the effect effee dof bof of this bill will be in my opinion to the survey and sale peany of any timber lands landa or timber upon the lands in tiie the states and territories named thus cutting off large prospective revenues reven that might aud should be derived from the sale of such sueh lands or thet timber on them it is equivalent to io a donation of all ali he timber lands to the inhabitants of those states and territories which will now be found to be the largest donation of the public domain hitherto made by congress this bill authorizes the registers and receivers receive is of the land the districts in which the lands are situated to makeen make investigations without any specific directions from the secretary of the interior of or commissioner of the general land office to bettle bottle and bwll accounts aad re the moneys coming into t trani the saie sale of lands lauds buch auch amoun they may expend or cadet cause to be esc eSi expended this method will vill be found ex exceedingly cee expensive and result in no good experience has shown that the machinery of the land offices ia Is wholly inadequate to prevent the depredations schurz continues the rules and regulations issued in pursuance of the farst first section of this act are to bo be found in the report of the commissioner of tho the general land office herewith here bere with presented these rules were drawn up with a view boand intention ii of preserving young timber and undergrowth upon the mineral lands of the united states and to tho the end that the mountain bides aides s may not be left jett denuded and barren barron of the timber berand and undergrowth neb necessary essary to p a precipitation of the rainfall and anu melting of anqus in floods upon the fertile arable lands in the valleys below thus destroying the agricultural and pasturage interests of the mineral and mountainous portion portions of coull country ty make it umber timber of a certain alze aize be cut and that young trees and undergrowth be protected and that tim ber be cut out only for the purposes mentioned in the act these rules and regulations will be enforced with all the power left it to this department part ment to that end in order to save what may be saved raved but I 1 deem it my duty to call attention to the fact as set forth b by the commissioner missioner in the letter above quoted that the machinery af the land offices is utterly inadequate to accomplish com the object in view after careful consideration of the above named act and its probable effects I 1 venture the prediction that the permission given the inhabitants of the stasea and territories named therein to take timber from the public lands in any quantity and whenever they can nind rind it for all purposes except export and sale to the railroads will be taken advantage of or not only by the tho settlers sett lors and miners to provide economically for their actual current wants but by persons who see in this donation a chance to make money it will stimulate a h wasteful consumption beyond actual need and lead to wanton deat destruction ruction that the machinery left to this department to prevent pr event such waste and destruction through the enforcement of the rules above mentioned will prove An entirely inadequate that as a final result in a few years the mountain sides bides of these states and territories will be stripped bare of the timber now growing upon them with no possibility of its reproduction if it once onee tbt e w wasted interest interests in ni mountainous 0 U lita tita inous regions will undoubtedly be sacrificed and the valleys in the course of time will become unfit for the habitation of man the act for the tho sale of timber lands jit jik bithe the states of california oregon and nevada and in wash territory passed by con gt aiton at its last session is commented upon by the commissioner of the general and land office as fol foi follows lows it is a bill of local and not general application to timber lands of the united states and adds one more to the special acts for the disposal of public domain the price fixed is too low as sis much of the laud is worth from 5 to 30 per acre under the provisions of the bill the timber randa will in my opinion be speedily taken up and parsed into the hands bands of speculators specula lorm lora notwithstanding withstanding the provisions to pre pro vent such a result boil should nut not bo be sold with timber where land laud Is not fit for cultivation only timber of certain sizes should be he sold and young timber retained with a view to the reproduction of forests the bill should have limited the hale sale of lauds lands to persons persona who have farin farms sand and homes home within swithin th the estate detate or territory and it ought to have required purchasers to show affirmatively that they baj bal need of th the 0 timber for domestic uses the last clause of the second section will permit dermit any uny person applying for hor a tract of timber land and securing a certificate from the register to sell his right and interest therein immediately and the pur chaer although it may have been obtained by perjury may be entitled to the land section five provides that any person prosecuted under section 2461 of the revised statutes
