| Show PUBLIC WANTS D PUBLIC OFFICERS CASTLE CAsTL DAIE EDALu emery county utah july editor dweres deseret neau loews myself with others wishing to get a little uttie inform information atlon on a subject which interests us at the present time in this locality ye we tak tae the llie liberty to enquire through the columns of the NEWS nab in regard to the powers of county courts in relation to county roads when the majority of the people in a pr precinct e petitions for a county road which is not only for the benefit of the people in the precinct but din diu erent rent pai ts of the county and Is also the only roal road traveled by the public at the present time no remonstrance being put in against said bald road except a verbal one by a member of the court we wish to know if the peaple people ye plo pio have any rights that the county court should recognize or if the selectman of a precinct is supposed to work for or against hla hia constituents please reply and oblige LIVE nive AND LET LIVE the powers of 0 county courts conita in relation to county road roads are clearly defined in the act pertaining to highways approved feb 10 1880 and among them are these 6 fo ro divide where not already done the county into a suitable and convenient number of road district 2 to cause to be surveyed viewed laid our out recorded opened and worked buch such such highways aa as are necessary neo auary euary for public convenience to cause to be bo recorded as highways such roads as have become such sueh by usage or abandonment jo 50 the public to abolish or abandon such as are unnecessary etc from the letter of livo live and laet let live we are unable to determine whether lie he and his friends want a new now road laid out or an established road worked and improved but in either case it is supposable suppo sable sabie that the county court composed of officers elected by the people to act for the interests of the people will consult the wishes of the people and study the public convenience thom off omm meers officers are the ser Ber servants of the people rie ele not their masters and dicta dictator tors toro but ut at the same time there is 0 of f necessity a certain amount of dl diacre cre ere tian conferred upon them and they are not supposed to be guided and controlled by any individual or faction notion but in the matter of highways in the language of that phrase of the law liw which we have italicised italicized sed pro vide tide such as are necessary to the pu public le convenience and the county coutt must be the judge of what Is necessary for the general public not merely for the benefit of my any given section of the county many considerations enter into the determination of questions such aa as this the financial ability of the county the necessities of the case viewed generally rather than local jy ly the benefits likely to result com corn pared with the outlay other demands of a similar chara ehara character oter oten which may bo be more moro urgent and meritorious and sundry and divers interests that tha the men looking after the whole county can understand and determine better than the people in a certain section all need to be wel wei weighed hed and compared it would ili ill become us to decide upon tho the questions ques tlona tiona propound ed edwith wi th me the limited information imparted by the above letter tho the selectmen are to their the offices if thoy they do not carry out the wishes of the people they can be left out when their term expires they are under tinder bonds to perform tho the duties cf of their office ralth fAlth faithfully fully but they are not under any legal or coial obligation to comply with the labes oi ol every person or combination of persons with private notions of public necessities or they would be perpetually I 1 lo 10 a hot water it is impossible for a public officer to please everybody every body and nd while any public servant manifests a deposition to do the best he can for the general good be he should ba sustained in ja hla hia position but if he is dise djs n regard his own notions or inta inte r CU afus as above the wishes and necessities of the public he should be shipped as soon as possible to make way for one who will observe both the letter and spirit of the law governing his position offices in sparsely spa reely settled regions are often very viry unthankful and BO so are the people who choose men to fill them the public should bo to reasonable the officers should be public spirited and approachable |
