Show LOCAL AND OTHER batters MATTERS FROM THURSDAYS DAILY JUNE IL 11 A wely WELI KNOWN brutally ALLY abused BY A SOLDIER about seven last night judge solomon P mccurdy exas ex As justice of Utah was walking quietly along the west side of first east street t near mr J W snells idaho sto store e when he was accosted and then violently seized by a drunken sold soldier ler ier who pushed him across the water ditch and then throw threw him upon his back on the street judge jud go mccurdy who is an elderly and very inoffensive gentleman got upon his feet and again crossed the foot toot bridge and got upon tile the sidewalk the soldier went at him again and this time knocked the poor old man head filst first into t the he ditch and as the bank hank is between three and four feet high at that point it is a wonder his neck was not broken by this time the attention of some citizens was attracted to the 11 scrimmage and just as the judge was thrown into the ditch one of them darted upon the soldier and struck him a blow in the face with his fist sending him upon his back some of the bystanders mostly boys then seized him and so great was the indignation that there was a cry of duck him 1 judge snow however in in fronton front of whose residence the affair happened interposed and advised them to take the soldier to tile the city hall which they did and ho he was placed in jal jail 1 meanwhile judge mccurdy was lifted out of the ditch ind and his clothes wiped down by those aroun around d the old gentleman shed tears at being thus maltreated mal treated just previous to the occurrence of the circumstances above narrated the same soldier whose name is thomas hackett hankett went into the great western saloon S south street and called for beer which he refused to pay for and a scuffle ensued between him and the barkeeper bar keeper the latter ejecting him from the premises after getting him out the first time the bartender had to stand at the door and kep keep him at bay fora forn for a consi considerable demable time lime and every time lie he would make a rush for the door the beer man who is of small stature would kick at him until he got fairly out of wind and the soldier got inside a second st second cond time but was finally kicked out this morning Dinwid dey from camp douglas called upon justice clinton and demanded that the soldier should be given up to him which demand was not acceded to and the lieutenant left saying that was all lie he wanted an affidavit was made against hackett by judge Z snow charging him with assaulting abusing and antl maltreating mal treating judge mccurdy the accused was brought into coult and in answer to the char gestated that he did not recollect anything about the affair and as judge mccurdy was unable to appear this morning the case eme was continued until ten tomorrow to morrow morn ing A rumor got around upon the street that Dinwid dey had telegraphed to camp douglas for a posse of troops to break open tile the jail and take JE fl ackett rackett forcibly from the custody of the civil authorities and a large crowd gathered in front of the city hall governor woods was running around in that locality apparently somewhat nervous and ana not a little excited and making anxious inquiries for pony duncan as he called the woods mckean marshal if soldiers can maltreat and antl abuse peaceable citizens and go 90 scot free from the penalties attached to the civil laws which they thus break it is time that it was known ow U if military law is superior to the civil law it should be demonstrated but it is the unflinching opinion of those who ought to know that that kind of rule will not nou be held good by the civil courts if be taken there for decision it is not merely one class of citizens that Is ig interested in this matter bitt blit all |
