Show WiOTHB 4 B Revamp license law? By Roger Pusey Deseret News staff writer Current methods to force dmers t surrender suspended or revoked licenses arc largely ineffec- tive. This is one of the conclusions reached by Dr Lenius M Knighton, legislate e auditor general, in a program audit of the driver control and driver unprov ement programs in Utah Knighton said under Utah law it is a misdemeanor for a person to drive while his license is suspended or rev oked The available evidence indicates that a high proportion ot drivers with suspended or revoked to drive, the report said licenses Knighton, who released the audit Wednesday, said, we found the driving behavior of these drivers can be improved by enforcing the statutory requirements that suspended or revoked licenses be sunendered by the drivers To do this, Knighton recommends passage of legislation providing greater incentive for drivers to surrender licenses lie also recommends that a study be made by tin1 Driver License Division to determine the causes for (lie courts not obtaining licenses when dmers are coin icted or revocable offenses Other include recommendations made in the audit Legislation be enacted to clarify several issues oh ed m the procedure for notify mg a di iver of his license revocation The Office of Legislative General Counsel be directed to study the status of the Implied Consent Law and report to the Legislature. inv Under this law, the Driver Incense Division conducts formal hearings for drivers who refuse to submit to blood chemical tests when requested by a police officer These decisions can be appealed to the courts. The Legislature study extending the limited dm ing privilege to other drivers who reeeiv e license revocations, but who are ineligible for such privileges under present statutes. The Legislature shouia review the intent of Utah law commonly called the Section First Offender Probation Program and take appropriate action to restore uniformity of treatment m all traffic cases Knighton said that section of law allows courts to place defendants on probation on a guilty plea of conviction of any crime or offense n undetermined number of courts now use this statute to place drunk drivers on probation under the First Offender Probation Program If the Legislature determined the first offender program should be continued, he recommends legislation pioviding for proper court reporting of these programs Knighton said at present it's possible to be placed on probation under the first offender program bv more than one court That's because some courts don't leport the names of those drivers placed on probation to he Driver License Division Further studv to develop alternate or additional treatments for diunk drivers We found that a relatively constant percentage of drunk drivers can be expected to receive additional alcohol related conuctionc no motier which treatment they receive, Knighton said Transportation regulation is needed, Rampton says Gov Calvm L Rampton Wed- nesday said he doesnt favor a bill before Congress that would eliminate regulation of U S transportation.
