government preparatory to their admission into the union when they have the requisite population concluded from last number sec see 14 and be it further fur ther enacted that every person not being a qualified voter vote accor according dim din to tie tha provisions ot 01 this act who shall vote at any election within tile the said territory knowing that lie la is not entitled to vote had every person who shall bhail at the same election vote more than once at the same samo or different place shall be a judged guilty of misdemeanor and be punished by a nine tine of not less than one hundred dollars nor exceeding two hundred and fifty dollars or by imprisonment not less than three months nor exceeding six months mont lis ils or both sec see 15 and be it further enacted that aul all any auy y person erson whatsoever who may ba be charged wih wili bolding holding the election herein authorized who shall aia ully and knowingly commit any fraud or irregularity whatever with the tiie intent to hinder hinders or prevent or defeat a fair expression of the popular will in the said elect election lon non shall be guilty of a fa 1 sae saem meanor ranor and punished by r fine I 1 tle tie not less than five fir bundred dollars nor exceeding one thousand imprisonment not less than six months nor exceeding two years or both at the discretion ion lon of the tho court sc 16 and be it further enacted that tile the delegates thus selected shall assemble in convention tin at the capitol of said territory on the first monday in december next and when so assembled snail first determine by a majority of the whole number of members bembe r s elected whether it be or be not expedient at that time to form a constitution ution and state slate government and if deemed expedient shall shap proceed to 10 forma form A constitution and state government which shall be alican in its form for admission into the un unto 10 nion aion an equal footing with the original state states m bli all i I 1 respects whatever by the tle name of the state stale of kansas with the following boundaries to wit beginning ng oil on the western boundary of the state of missouri rl where the thirty seventh parallel of north lati iati latitude latitus crosses the same then tilen west oil on said parallel to the tile hundred and aud third meridian of longitude then north on bad sad said meridian to the tile fortieth parallel of ii lanade Wude then east on said parallel of latitude to ha lie western boundary of the state of Misso missouri url uri vilen ihen then southward with such boundary to the beginning and until the next congressional apportionment the tho said state shall have one representative in the house of representatives of 0 the unite united A states sec see 17 and bo be it further furt lier ller enacted that said commissioners shall receive as their compensation ten dollars per day during ther attendance on the business of said commission beginning on tile the day they depart from home aud and their actual expenses and said ecret ary dry of tile the board the sum of eight dollars per day computed in like manner and his expenses and the said assistants for taking the census shall receive such reasonable compensation pensa tion as the board shall deem just and equitable sec see 18 and be it further enacted that inasmuch as the constitution of the united states and the organic act of said territory have secured to the inhabitants thereof certain inalienable rights rig lits they cannot be deprive dby any legislative enactment therefore no religious test lest shall ever be ile required as a qualification to any office or public trust no do kw law shall be in force or enforced in said territory respecting an establishment of religion or prohibiting the free exercise exer cis thereof r or abridging the fre freedom edorn of speech or of the press or of tile the right of people peaceably to assemble and petition for the redress of grievances the tiie right of the people to be secure in their persons houses papers and effects against unreasonable searches barches ear ches and seizures shall not be violated and no warrant shall issue but upon probable cause supported by oath or affirmation affirmations and particularly describing the place to be searched and the person or things to be seized nor shall tile tiie rights of tile tiie people to keep and bear arms be infringed no person shall be held to answer for a capital or otherwise infamous crime unless on a presentment or indictment of a grand jury nor shall bhail any person bo be subject for the same offense offence to be twice put in jeopardy i of life or limb nor shall be compelled in any criminal case clise to be a witness against himself norbe deprived of lifes life liberty or property without due process of law nor shall shail private property hi bi taken for public use without just compensation in all criminal prosecutions the accused shall enjoy the right to a speedy and alid public trial by an impartial jury of the di district wherein tile crimes hail ball have been committed which district shall have been previously previous 17 ascertained by law lax and to be informed ot 01 the tile nature and cause 0 the accusation to be confronted with ith the witnesses against him to have compulsory process of obtaining witnesses in fit his favor and add to have the tile assistance of counsel for his defence the tile privilege of habeas corpus shall not be suspended unless when in case of rebellion or invasion the public bublic 1 safety may require it in suits at bommon common common f aw w where the tiie value in controversy shall exceed twenty dollars the right of trial by jury shall be preserved and no fact tried by jury shall be otherwise wise examined reexamined re in any court of the united states than according to the llie rules of the common law excessive bail shall not be required lorex fines imposed nor cruel and unusual punishments inflicted no law shall be made or ois have force or effect in said territory which shall require a test oath or oaths to support any act of Lo congress ogress or other legislative act as a qualification for any civil office or public trust or for any employment or profession or to serve as a juror or vote at any election or which shall impose any tax upon or ed condition to the exercise of the agh right t of opinion thereon by the people of said territory sec see 19 and oe de il it further enacted that the following low lil ill propositions be and tile tiie same are hereby offered to the tile faid paid convention of the tiie people of kansas for their free acceptance or rejection which if accepted by the convention shall bo be obligatory oil on the united states and upon the said state of kansas to wit First Th t sections numbered sixteen and thirty six in every township bf public lands in said state stale and where either elther of said sections orally or any part thereof has been sol or otherwise been disposed iother rother of olier thereto and as contiguous as may be shall be granted in laid inid state for lor the use of schools second that seventy twe two sec ions lions of land shall shail be set a apart I 1 I 1 rt at and 1 d reserved for the use and support of a 91 state slate L te U university niver alver sity to be selected by the governor of said state subject to the approval of the commissioner of the llie general land lind office and to be appropriated and applied in such manner as the legislature of said state may prescribe for the purpose aforesaid but for lor no other purpose third that ten entire sections of land to be selected by tile governor of ald taid laid aid state stale in fit legal subdivisions shall be granted to baij state staw for the purpose of completing the public buildings or for the erection of others at the seat sent of government under the direction of the legislature legislators thereof fourth that bit bil salt springs within said state not exceeding twelve in iiii riber with wilh six sections 0 of f land adjoining or as contiguous as may be to each eacil shall be granted to said state stale for its use the same to be selected by file tile governor thereof w within athin one year after the admission of said state and when so selected to be used or di disposed poad of on such terms conditions and regulations is ts the legislature shall direct provided that no salt sprin spring g or land the right whereof is now DOW now vested in fit any individual or which may be hereafter confirmed or adjudged to any individual or individuals shall by this article be granted to said state fifth that five per of the net proceeds of sales of all public lands lying iving within said sald sate sale which shall be sold by congress after the admission of 0 sad said state into the union after deducting all tile the expenses incident to the same shall be paid to said state for the purpose of making public roads roads and internal improvements as ahe lle ile lie legislature shall direct provided tile the foregoing propositions herein offered aie ate on the tile condition that the tile said convention which shall form the constitution of said state shall provide by a clause in said constitution ution or en ordinance ir without the bonsen of the united states that said state shall shail never interfere with the primary disposal of the soil within the same by the united states slates or with any regulations congress may find necessary for securing the title in said soil to bona fide purchasers thereof and that no tax shall be imposed on land belonging to the united states and that in no case shall nonresident non tion resident proprietors be taxed higher than residents sec see 2 1 and be it further enacted that the president be and is hereby authorized and empowered upon application of the said board of commissioners to employ such military force foree according to existing laws as he shall deem necessary to secure the faithful execution of the provisions of this act |
