ORDINANCE ON 1 SALES TAX The Board of County Commissioners of the County of Sevier ordains as follows: Section 1 Definitions Section 2 - Restaurant prepared Food and Beverage Tax Section 1 : As used in the ordinance: (1) Convention facility means any publicly owned or operated convention center, sports arena, or otherfacility at which conventions, conferences, and other gatherings are held and whose primary business or function is to host such conventions, conferences, and othergather-ings- . (2) Cultural facility" means any publicly owned or operated museum, theatre, art center, music hall, or other cultural or arts facility. (3) Recreation facility' or tourist facility" means any publicly owned or operated park, campground, marina, dock, golf course, waterpark, historic park, monument, planetarium, zoo, bicycle trails, and other recreation or tourism-relate- d 835-87- 81. "Restaurant" does not include any retail establishment whose primary business or functions is the sale of fuel or food items for but not immediate consumption. The qualified electors of the City approved a general obligation "bond in an amount not to exceed $1,000,000 for these purposes, $873,000 of which was issued and sold and the Ordinance levying assessments is for the purpose of providing debt service on that bond to avoid the imposition of ad valorem or property taxes which otherwise would be required under the Constitution and laws of the State of Utah if funds are not available through fees and taxes assessed in the Ordinance. The Ordinance is based on the findings that the City has issued a General Obligation Bond in the amount of $873,000 for the express and restricted purpose of street and sidewalk construction and that under the provisions of Title 10, Chapter8, and other provisions of Title 1 0, Chapter 8, and otherprovisions of the "municipal Code portion of Utah Code Annotated 1953, the City has authority to establish, repair, open or alter, widen, narrow, pave or otherwise improve streets, alleys, avenues, parks, and other public facilities of the City and may regulate among otherthings the use of streets, sidewalks and public grounds and remove obstructions and ' " ' ' encroachments thereupon. The Ordinance, among other things, provides for an assessment on Main Street properties of $3.50 per month per lineal foot and $8.00 per month for each parcel or improved or unimproved realty forstreets and sidewalks including both those within and without the business sector of the City. An assessment of properties on Main Street shall be on a lineal foot basis shall be in addition and supplemental to the $8 00 per month levy on improved parcels. The Ordinance provides that all funds realized from impact fees, levies or assessments under the Ordinance shall be used to the purpose of providing debt service to retire the $873,000 in General Obligation Bonds issued and sold by the City for the express purpose of improvement to the streets, sidewalks, infrastructure and other public ways or public properties within the City of Manti. The ordinance takes effect immediately upon passage and publication in the Manti Messenger of this Summary of the Ordinance.
