IN STATE PRISON Cain & Richardson receive sentences Sixth District Court Judge Don Tibbs, sentenced Joseph Michael Cain III and William Earl Richardson to spend the next several years in the Utah State Prison. Tibbs had denied the defense attorneys request for a 90 day psychiatric evaluation, and ordered the men to begin their terms immediately. Cain, 19, and Richardson, 26, both of Salina, were sentenced on charges of aggravated burglary and grand auto theft. The charges resulted from an alleged bizarre bank robbery scheme, that ended prematurely in a spectacular explosion in the foothills west of Johnson Feed Lot, in Aurora, on May 20th. Cain and Richardson told law enforcement officers that they had set up a scheme to steal explosives, and later blow up the Petrolane Gas Service in Richfield. They then planned to rob a Salina bank while the resulitng chaos was being handled from the bombing in Richfield. The two men had broken into storage sheds containing explosives from U.S. Gypsum and Georgia Pacific, in Sigurd. An informant had notified local police of the intended plan prior to the explosion date, and officers had been keeping surveilance and had warned some of the businesses involved. The two men later said they had abandoned their original plan and were only going to sell the explosives. Early on the morning of May 20th, the men entered a residence on the Johnson Feed Lot, and robbed the occupants at gunpoint. They were seen by one of the owners of the feedlot, who followed them into the foothills while another man called the Sheriff. As Sheriff Billy Weaver came on the scene and was radioing for additional support, the truck containing the explosives blew up, throwing Richardson about 200 feet. Cain was not injured and ran from the scene, and was the subject of a six hour manhunt. Sevier County Attorney Don Brown no,ed that This scenario had the potential for the most widespread destruction Southern Utah has ever seen." He called the scheme horrendous beyond description. Aggravated burglary is a first degree felony and carries a sentence of five years to life. Grand auto theft is a second degree felony with a sentence of one to 15 years. The mens judge ordered the two sentences to run consecutively. In recommending the maximum sentencing. Attorney Brown called Cain and Richardson, two of the most dangerous people this court has had before it in a long time. Sheriff Weaver also called for maximum sentencing due to their wanton disregard for human life. Richardson's attorney noted that there was a lack of information concerning his medical and mental health background, and requested a 90 day psychological evaluation, which was turned down by Judge Tibbs. Cains attorney Marcus Taylor, also requested a 90 day evaluation for his client as Cain is only 19 years old; Drug use was paramount in his problems and he was heavily under the influence of drugs when the incident occurred; and Cain has no prior adult criminal record. Cains mother also told the judge that drugs were her sons problem, along with his choice of friends. In rendering sentence, Judge Tibbs said drugs are no excuse for an action. He said, I have a larger duty to the people of Utah. Time has come when somebody must put a stop to this behavior.
