Section 3: License Revocation No AN ORDINANCE FOR THE CONTROL OF DOGS AND OTHER ANIMALS The Licensing Authority may revoke any license if the person holding the license refuses or fails to comply with this ordinance, the regulations promulgated by the Licensing Authority, or any law governing the protection and keeping of animals. (a) AN ORDINANCE PROVIDING FOR THE CONTROL OF DOGS AND OTHER ANIMALS. PROVING FOR THE LICENSING OF DOGS AND FEES THEREFORE PROVIDING FOR CIVIL AND CRIMINAL PENALTIES FOR VIOLATIONS. Section I. Definitions As used in this Ordinance the following terms Mean: Animal: Any live vertebrate creature, domestic or wild. . . Governing body: The governing board, council or commission of Utah. Keeper: Any person, partnership, or corporation owning, keeping, harboring or having custody of one or more animals. Licensing Authority: The Rich County Sheriff s Office or such other agency as the governing body may from time to time designate. Pet: Any animal kept for pleasure rather than utility. (b) Any person whose license is revoked shall, within ten days thereafter, humanely dispose of all animals owned, kept, or harbored and no part of the license fee shall be refunded. (c) It shall be a condition of the issuance of any license that the Licensing Authority shall be permitted to inspect all animals and the premises where animals are kept at any time and shall, if permission for such inspections is refused, revoke the license of the refusing owner. SECTION 2. Licensing (a) Any person owning, keeping, harboring, or having custody of any dog over three months of age within this jurisdiction must obtain a license as herein provided. (a) Impounded dogs shall be kept for not less than three working days. (c) If by a license tag or other means, the keeper of an impounded animal can be identified, the Licensing Authority shall immediately upon impoundment notify the keeper by telephone or mail. (d) A keeper reclaiming an impounded dog shall pay a fee of $20.00 plus $5.00 for each day the animal has been impounded. (e) Any animal not reclaimed by its Keeper within three working days shall become the property of the local government authority, or humane society, and shall be placed for adoption in a suitable home or euthanized. (f) In addition to, or in lieu of, impounding an animal found at large, the Licensing Authority officer, humane officer, or police officer may issue to the Keeper of such animal a notice of ordinance violation. Such notice shall impose upon the owner a civil penalty of $20.00 which may, at the discretion of the animal Keeper, be paid to any agency designated by the Licensing Authority within hours in full satisfaction of the assessed seventy-tw- o In the event that such penalty is not paid penalty. within the time period prescribed, a criminal warrant shall be initiated before a magistrate and upon conviction of a violation of this ordinance, the owner shall be punished as provided in Section II of ' this ordinance. - (e) License fees shall not be required for seeing eye dogs or governmental police dogs. (f) Upon acceptance of the license application and fee, the Licensing Authority shall issue a durable tag or identification collar, stamped with an identifying number and the year of issuance. Tags should be designed so that they may be conveniently fastened or riveted to the dogs collar or harness. (g) Dogs must wear identification tags or collars at all times when off the premises of the owners. (h) The Licensing Authority shall maintain a record of the identifying numbers of all tags issued and shall make this record available, to the public. Adjourment (1) Any person, individual, public or private corporation, government, partnership, or unincorporated association or firm violating any provisions of this ordinance shall be guilty of a Class C Misdemeanor and shall be subject to imprisonment for not more than ninety (90) days and-o- r a fine of not more than $299.00. Upon any violation of this Ordinance, the Licensing Authority or his representative, or any agent of the Bear River Health Department may prepare in triplicate or more copies of a written notice to the person in violation to appear in Court; containing the name and address of such person, the license number, the breed, sex and color of the animal, the time, place and offense charged, and also the time and place where such person shall appear in Court. (g) The owner of an impounded animal may also be proceeded against for violation of this ordinance. (3) The time specified in said notice to appear must be at least ten(10) days after such issuance, unless the person in violation shall demand an earlier hearing. (4) The place specified in said notice to appear must be made before a magistrate within Rich County. (5) The person in violation may make a written promise to so appear in Court by signing at least one copy of the writtemnotice. If the written promise tq appear is signed, a copy of said notice shall be given to the person promising to appear, and the original shall be filed with the magistrate before whom he is to appear. The original 6f this notice fried with the Court shall, in lieu of a verified complaint, constitute a complaint to which the defendant may plead guilty. Any person who fails to appear after the written promise to appear in Court, is guilty of a violation of this ordinance. If the person in violation refuses to sign the promise to appear, a verified complaint must be fried before a magistrate within the County against the person in violation, thereupon a Summons to appear will be issued out of the magistrates Court. (6) Section 12: Conflicting Ordinances All other ordinances of this jurisdiction that are in conflict with this ordinance are hereby repealed to the extent of such conflict. Section 13: Severability Clause If any part of this ordinance shall be held invalid, such part shall be deemed severable and the invalidity thereof shall not affect the remaining parts of this ordinance. Section 14: ' Effective date This ordinance shall be effective fifteen days after its publication.
