The marriage was lal.DS ter solemnized in the Salt , sisters: J. Rex, Mrs. James (Neva) Hawkins, Mrs. Aft on Puff, all of Tooele. Funeral services will be held Friday, 12 noon, at McDougal Funeral Home, 4330 S. Redwood Road where friends may call Thursday 6 p in. until 8 p.m. and Friday one hour prior to services. Interment will le in the Tooele Temple. As a young man he served an apSmelprenticeship at the International ter at Tooele and later was employed by Combined Metals Reduction Co., at Bauer. He transferred to Henderson, Nevada in 1958 where he retired from American Potash Co. in l'X4. STEWART Kent Stewart AN ORDINANCE GRANTING TO MOUNTAIN FUEL Sl'PPLY COMPANY, A CORPORATION OF THE STATE OF UTAH, AND ITS PUBLIC UTILITY SUCCESSORS IN INTEREST, A FRANCHISE FOR THE CONSTRUCTION AND OPERATION OF A GAS DISTRIBUTION SYSTEM IN THE CITY OF TOOELE, Kent Stewart, 41, died May 2, 1978 in a Salt Iatke hospital. He was born on Sept. 29, 1333 in Meadow, Utah to Harold William and Belva Bell Bush-ncll Stewart. STEWART married Sharon Carling on June 4, 1951 in the Manti Temple. He was employed at Dugway Prosing Ground for 21 years and at the Tooele LDS Stake Center for the MRS. GILLESPIE MR. Pearl N. Gilles pie Pearl N. Gillespie, 92, a former resident of Tooele passed away on May She was bom 1, 1978, in California. Sept. 5, 1885 in Tooele to William W. and Elizabeth R. Nelson. She married William C. Gillespie on Jime 19, 1905 in Tooele. The marriage was later solemnized in the Salt Lake LDS Temple. Mr. Gillespie died on Oct. 15, 19(58. Site was active in the LDS Church auxiliaries, a former Relief Society president, member of the Daughter of the Utah Pioneers and President of the Lahoealie Club. Funeral services will lie held at the Tooele Fourth Ward on Friday at 12 noon. Friends may call at Tate Mortuary on Thursday from 6 p.m. until 8 p.m. and Friday one hour prior to services at the ward building. bitennent will be in Tooele City past five years. CONDITIONS AND TERMS BE IT ORDAINED BY THE TOOELE CITY COUNCIL that the following is herewith adopted as Title 1, Chapter 18, Sections 14 through 24, Tooele City Bicentennial Code: 1 GRANT OF FRANCHISE TO MOUNTAIN FUEL SUPPLY COMPANY: There is hereby granted to Mountain Fuel Supply Company, a Utah corporation, and such public utility successor or successors in interest as may hereafter acquire a right and interest in and to all the property, business, and assets of Mountain Fuel Supply Company, hereinafter collectively called Grantee, the right, privilege and franchise to construct, maintain and operate in the present and future streets, alleys and parkways, and other public places in Tooele City, a municipal corporation of the State of Utah, a system of gas mains, supply pipes and laterals with all necessary or desirable appurtenances, for the purpose of supplying gas for light, heat, power and other purposes to Tooele City, the inhabitants thereof, and persons and corporations beyond the corporate limits thereof, for the term and under the conditions hereinafter set forth. 1 COMPMOUNTAIN FUEL SUPPLY ANY SUBJECT TO REGULATIONS OF CITY: During the life of this franchise, the Grantee shall be and is subject to all lawful exercise of the police power of the City of Tooele, and to such reasonable regulations and license provisions thereunder as the City may by ordinance provide, including the right of the City to supervise and provide for the location of all mains, pipelines and laterals of the Grantee. 1 MOUNTAIN FUEL SUPPLY COMPANY TO PROVIDE REGULATIONS CONCERNING CONSUMPTION OF GAS: Grantee may make and enforce reasonable rules and regulations in the conduct of its business and may require before furnishing service the execution of a contract therefor. Grantee shall have the right to contract with each consumer with reference to the installation of service pipe lines and the control of service pipes from the connection thereof with the supply lines of the Grantee in the Streets, to and including the meter located on the consumers premises. For the purpose of securing safety and good service to the consumer and in the public interest, Grantee shall have the right to prescribe the sizes and kinds of the pipe to be used by the consumer in conveying gas on consumers premises, and shall have the right to refuse service to any consumer who neglects or refuses to comply with the rules and regulations of the Grantee prescribing such conditions, so long as said rules and regulations of Grantee are not contrary to the ordinance of Tooele City. Grantee shall have the right to classify the consumer of said gas in the corporate limits of the City according to the time of use, character of use, quantity of gas required, and such other conditions as may be reasonable; subject to the regulations herein provided, the rights herein prescribed and such reasonable classifications as Grantee deems necessary. The Grantee shall furnish gas without unjust discrimination and to all persons along the established lines or mains of the Grantee who have properly observed such rules and regulations and acceded to the rights herein reserved to the said Grantee. I RATES FOR GAS SUPPLIED TO BE ESTABLISHED BY STATE AND FEDERAL LAW: The rates and prices which the Grantee, its success- - other terms, and conditions of Tooele City, Crantee shall remit on a monthly basis to Tooele City a franchise tax in the sum of 4 percent of the gross receipts of Crantee, received by Grantee, and attributable to Grantees business enterprise within the boundaries of Tooele City for the thirty days preceeding. Said tax remittance shall lie in lieu of all other franchise taxes, business licenses, building permit fees, and other like fees and charges upon the revenue, property, gas mains, gas supply distribution pipes, equipment, fixtures, other appurtenances, or activities of the Grantee, and all other property or equipment of said Grantee, or any part thereof. Tooele City shall have the right to examine the books, ledgers and accounts of Crantee during all regular business hours at Grantees Tooele Branch Office in order to verify the amount of gross revenues received by Crantee, or for any other legitimate business purpose.
