The grader was maintaining Class D roads claimed by San Juan County on Harts Point, in an area that was under consideration for wilderness designation. While a large portion of the November 25 trial addressed at length some of the larger issues involved in the confrontation, Kent was found guilty on three misdemeanor counts. San Juan County Sheriffs Deputies were called to the scene after Kent and two other environmental protesters stopped road grading activities by standing in front of the grader. Sheriff Mike Lacy, accompanied by four deputy sheriffs, informed the protesters that they were trespassing and that they should leave. Kent refused to move and was arrested. While Kent was arrested and found guilty of disregarding the warnings of a police officer, much larger issues were involved, including rights of way, wilderness designation and other federal lands issues. Kent was represented by Moab attorney Steve Russell, who argued that Kent was simply attempting to make San Juan County obey a written cease and desist order issued earlier by BLM Manager Kent Walter. The agreement, which was discussed by the San Juan County Commission on November 25, requires San Juan County to notify the BLM at least 48 hours before beginning any road work on two track routes or Class D roads on federal property in San Juan County.
