Bryner 14-Jud- ge A 43 year old defendant was in court for a review hearing on a class A misdemeanor charge of obstruction of justice. Defendant advised the court there had been no new law violations and the fine had been paid in full. The court finds the defendant has successfully complied with the plea in abeyance agreement and orders the charge to be reduced to a class B misdemeanor. Fine already paid. A 50 year old defendant was in court for a preliminary hearing on one second degree felony charge of aggravated assault. Upon motion, the court excluded the witnesses from the courtroom. The state called three witnesses and they testified. No rebuttal witnesses were called. The court found probable cause and defendant w'as bound over for trial. Sentence is to be served at the Utah State Prison and is to be concurrent with the term with the prison sentence he is pres- ently serving out of Millard County and another sentence from Emery County. Also ordered to pay a $500 fine. A 38 year old defendant was in court for sentencing on two second degree felony charges of distributeofferarrange to dis- tribute a controlled substance. The defendant w'as sentenced to an indeterminate term of not less than one year nor more than 15 years in the Utah State Prison on each count. Terms suspended. Fine of $925 plus interest, $260 restitution and 36 months probation also ordered. Conditions of probation include: no use, consumption or possession of alcohol or illegal drugs, nor association with persons using, possessingor consuming alcohol or illegal drugs; sene 90 days in the Emeiy County jail with no credit for time served; substance abuse evaluation; notice to all medical personnel that a conviction for drug charges has been levied; and submission to DNA test and pay for the test.
