In the ruling of the Supreme Court the United States on the matter of the Denver Union Water Works Co., vs. Denver City Corporation, on Monday of last week, the effect of the de cree reached clear back here to Brigham City. The case, in brief, was that of the private water works corporation, whose tranchise has expired, attempting to force the city of Denver to grant it new franchise or purchase its plant The city corporation took a notion, just before the franchise expired, to establish its own water works system and so when the corporation came of A . The court held that the contract between the corporation and the city was limited to 20 years, that being the max-iulength of time franchises can be of the city granted for by the charter of Denver, and in this case no definite date for the expiration of the franchise was given, but the franchise had its birth and went into effect in 1890, just twenty three years ego. Brigham City entered into an agreement with the Rocky Mountain Bell corTelephone Co., and granted that which expired a franchise poration several years ago. In the mean time the R. M. Bell Tel. Co. sold its plant to another corporation and when the matter of a municipal plant came up, argument wag presented to the effect that the corporation could not be ejected nor forbidden to operate in the community because of the provisions of the Post Roads act. Tne ruling of the Supreme Court states plainly that the contract between a city and a corporation, where. In a franchise is involved, ends at the expiration of the franchise and if the city does not care to grant a new franchise it can suit itself and the corporation will have to abide by the decision And what is more natural. If the pow er of granting or withholding fran chises is of no protection to a common wealth why should it be necessary for corporations to ask for that privilege; if the franchise is no benefit to the corporation in its operation why should the commonwealth hesitate to grant it and why should the corporation worry whether it got a franchise or not? . The facts remain, the telephone company is operating in Brigham City without a franchise, and what is more, this particular corporation never did have a franchise. Brigham City has the power to grant or withhold a franchise and if the city takes a rotion to establish a municipal telephone system of its own, be such action wise or unwise, the telephone corporation will have to accept the verdict and if the city tells it to move off the streets and out of town, according to the Suoreme Court of the United States, it would have to obey the mandate.
