Before the water shall be tinned on again, all delinquent water and sewer service charges shall be paid in full, plus a turn-o-n fee of twenty-fiv-e dollars ($25.00), if during normal working hours, or a turn-o- n fee of fifty dollars ($50.00) after working hours. The city recorder is authorized to enforce the payment of all delinquent water and sewer rates by an action in law in the corporate name of the city. Times-Independe- CITY OF MOAB ORDINANCE 87-0- 2 AN ORDINANCE OF THE CITY OF MOAB, UTAH, ADOPTING THE MOAB A MUNICIPAL CODE, w CODIFICATION OF THE PERMANENT AND GENERAL ORDINANCES OF THE CITY OF MOAB, UTAH. the Utah WHEREAS, State Legislature has provided for the codification and publication of the permanent and general ordinances of cities and towns in Section of the Utah Code Annotated; and the Book WHEREAS, of the Utah Code Annotated. 10-6-- Section 4. Ordinances passed prior to adoption of the code. The last ordinance included in the initial code is Ordinance 86-0- 2, passed May 6, 1986. The following ordinances,, passed sub- sequent to Ordinance 86-0but prior to adoption of this code, ae hereby adopted and made a part of this code: Ordinance 86-0Ordinance OrOrdinance 86-0- 5, Ordinance dinance 86-01 and Ordinance 87-0Section 5. Reference applies to all amendments. Whenever a reference is made to this code as the Moab Municipal Code or to any portion thereof, or to any ordinance of the city of Moab, Utah, the reference shall apply to all amendments, corrections and additions heretofore, now or hereafter made. Section 6. Title, chapter and section headings. Title, chapter and section headings contained herein shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or intent of the provisions of any title, chapter or section . thereof. Section 7. Reference to specific ordinances. The provisions of this code shall not in any manner affect matters of record which refer to, or are otherwise connected with ordinances which are therein specifically designated by number or otherwise and which are included within the code, but such reference shall be construed to apply to the corresponding provisions contained within this code. Section 8. Effect of code on past actions and obligations. BE IT ORDAINED BY THE CITY COUNCIL OF MOAB, UTAH: Section 1. Adoption. Title Citation This code shall be known as the Moab Municipal Code and it shall be sufficient to refer to said codeas the Moab Municipal Code in any prosecution for the violation of any provision thereof or in any proceeding at law or equity. It shall be sufficient to designate any 10-6-- -- ordinance adding to, correcting or repealing all or any part or portion thereof as an addition to, amendment to, correction or repeal of the Moab Municipal Code. Further reference may be had to the titles, chapters, and sections and subsections Moab Municipal of the Code and such references shall apply to that numbered title, chapter, section, and subsection as it appears in the code. Section 3. Codification authority. This code consists of all the regulatory and penal ordinances and certain orof the administrative dinances of the city of Mob, Utah, codified pursuant to the provisions of Section , Section 9. Effective date. This code shall become effective on the date the ordinance adopting this code as the Moab Municipal Code" shall become effective. Section 10. Constitutionality. If any section, subsection, sentence, clause or phrase of this code is for any reason held to be invalid or such deunconstitutional, cision shall not affect the validity of the remaining portions of this code. The council hereby declares that it would have passed this code, and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, or sentences, clauses phrases had been declared invalid or unconstitutional, then the original ordinance or ordinances shall be in full force and effect. WHEREAS, the Council has found the ordinance granting beer licenses to be cumbursome and drawn out and difficult to administer under certain conditions. WHEREAS, it is in the best interest of this municipality to amend the Moab City code to allow for a more orderly manner for the council to grant licenses for applicants to apply for and receive beer licenses. NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Moab that Section 5.20.210 of the Moab City Code of 1986, be amended as follows: Section 1. Section 5.20.210 is amended to read as follows: 5.20.210 Application-Poli- ce department referral. The application for such license, together with such information and certificate as is required by the city council to be attached there to, shall be referred to the city chief of police for inspection and report. The chief of police shall, as soon as possible, after receving such application, make a report to the council relative to the granting or denying of such application. Upon receipt of the report, the council shall act upon the application as it shall deem fair, just and proper in regard to granting or denying the same. Pending the report of the chief of police, the council may for good cause, grant a temporary license to an applicant not to exceed a period of three months, who shall state under oath or that applicant is a resident of Grand County, State of Utah, immediately prior to making the application, that applicant has no prior criminal record, and that no outstanding warrants or criminal complaints are on file or record against applicant in any jurisdiction.
