David Bresnahan will get to keep his concealed-weapo- n permit despite his having fired a warning shot to stop two suspects, state attorneys have decided. The state Department of Public Safety said today that Bresnahan is not charged with a crime of violence and the attorneys staff counsel J. Francis Valerga and Mark Shurtliff of the Attorney Genconcluded the law eral's Office provided no ground for suspending or revoking Bresnahan's permit. "According to the attorneys, the fact that Bresnahan acted in poor judgment and demonstrated an unfamiliarity with current laws defining lawful use of a firearm by a private citizen does not present enough grounds for revocation of his concealed weapons permit," the department said in a statement. The attorneys said the department must operate "within the guidelines of the statute and recognize the Legislature set the boundaries for suspension and revocation." activist Bresnahan, a who voted to ease restrictions on concealed-weapons permits, was charged last week with discharge of a firearm upon or across a high- gun-righ- BLM ts way, a class B misdemeanor. 'OK, I'll come back over,' " Huntington told The Salt Lake Tribune. The second suspect stopped and "very calmly" climbed back over the fence to the group of citizens, he said. Neither suspect has a criminal record in Utah. Bresnahan contends the suspects stopped running when he fired a warning shot into the mud. We had to stop them. Meredith has been manager of the BLM's Cedar City district office for the past 21 months. Effective immediately, he will be responsible for the daily management of the 1.7 million-acr- e monument that President Clinton established last month in southern Utah. It is the first national monument administered by the BLM. "Jerry has his work cut out for him," BLM state director Bill Lamb said Tuesday in announcing the appointment. The creation of the monument was opposed by state and local officials. Mark Walsh of the Utah Association of Counties said. "I'd like to see Jerry go back and take a more public approach to doing business, instead of the sneaky way they (BLM) have mastered in this administration. ... It's about time they put somebody in there who knows what's going on around here." "People have worked with (Meredith) and are comfortable he will be fair to deal with." said Yield Varela. spokeswoman for Gov. Mike Leavitt. "Because he knows this area and has working relationships with people, it will enable "We have an opportunity, if not the obligation, to try to build something completely new and fresh here something (hat add., diversity to the forms of land management heretofore found on- - (he federal lands of the West," he added. Since Clinton's creation of the monument. Meredith has been involved in BLM efforts to develop an administrative structure to operate the monument and to manage its natural resources. Meredith is the leader of an implementation team that, over the next three years, will develop a long-termanagement plan. "We're moving ahead with all deliberate speed and expect to e have a 12- - to planning team working on the land and with the communities during the next two to six months," said Lamb. m full-tim- PROHIBITS DISPENSING WITHOUT PRESCRIPTION LAW BuSPAff KCI, USP) (buspirone at Presorting Bnet Summary t2S4 for fmbmuDon. complete yescrting ntormjbon consji ottiu parxrof ptejse araj& CONTRNMKMMNS to buspirone Hypersensarvey WUIMNGr riydrrxtaoreje It Mmlllliill8ii5( Tl iM''l'''"""!!
