Where existing sidewalk, curb, and gutter is requested or caused to be removed by order of Midvale City, the city will pay for one hundred percent of the replacement costs. City participation will be based on the availability of funds. Priority of projects will be e established on a basis and on a basis. The city, however, will not participate in the construction costs of new sidewalk, curb, and gutter in those areas where new residential, commercial or industrial property is being developed. But, where existing developments do not have sidewalk, curb, and gutter and the city requires it or property owner requests it, the city will participate in the costs on a 0 basis. The city's share will come from community development money or other funds allocated for that purpose. Where the cost of the improvements are to be shared equally by the city and property owners, 75 percent of the owner's share must be paid prior to construction. The balance remaining, or 25 percent of owner's share, will be paid upon completion of the project.
