Nicole Boesken Area Defense Counsel An Article 15 is an administrative tool that a commander may use for punishment in disciplinary matters. When a commander believes that someone in the squadron has com- mitted an offense under the Uniform Code of Military Justice, the commander will offer the person an Article 15. The member may choose to accept the Article 15 ters (officers only). The punishment may be suspended, in whole or part, up to six months. Punishment in excess of one month, whether suspended or not, promulgates a entry in a unfavorable information file for enlisted members. An Article 15 is a mandatory UIF entry for officers. The commander acts like the judge, hearing and weighing all of the evidence and then determining a punishment. The punishment a commander may impose is limited by both the commander's and member's rank, as outlined in Air Force Form 3070 (Record of punishment.) Possible punishments may include reduction in grade, forfeiture of pay, restriction to base, extra duty, correctional custody and reprimand and arrest in quar- Non-judici- Summary eral conviction on their permanent record. (Punishment under Article 15 is not a conviction.) The Area Defense Counsel can look at members' cases and advise them on the best course of action. But it is up to the member as to what they want to do. The ADC is a qualified attorney who has been certified by the Air Force to perform duties as defense counsel.
