Show HILL TOP TIMES April 27, 1979 It's the Law: Utah State Code Driving Under the Influence, states that: "(a) It is unlawful and punishable as 4, provided in subsection (d) of this section for any person who is under the influence of alcohol, or who is under the influence of any drug or combined influence or alcohol and any drug to a HleDirfir(se! degree which renders the person incapable of safely driving a vehicle, to drive or be in actual physical control of any vehicle in this state." Section (b) Paragraph "D If there was at that time 0.05 or less of alcohol in the person's blood, it percent by weight shall be presumed that the person was not under the influence 1-- 3: of alcohol; (Paragraph 2) : "If there was at that time in excess of 0.05 percent but less than 0.08 percent by weight of alcohol in the person's blood, such fact shall not give rise to any presumption that the person.was or was not under the influence of alcohol, but such fact may be considered with other competent evidence in determining whether the person was under the influence of alcohol." (Paragraph 3) : "If there was at that time 0.08 percent or more by weight of alcohol in the person's blood, it shall be presumed that the person was under the influence of alcohol." Section 4, Paragraph d, stated that: "Every person who is convicted of a violation of this section shall be punished by imprisonment; for not less than thirty days nor more than six months, or by a fine of not less than $100 nor more than $299; or by both such fine and imprisonment ; provided that in the event such person shall have inflicted a bodily injury upon another as a proximate result of having operated said vehicle in a reckless or negligent manner or with a wanton or reckless disregard of human life or safety, he shall be punished by imprisonment in the county jail for not more than one year and at the discretion of the court, by a fine of not more than $1,000. Negligence Costs $$$: A privately owned vehicle, after failing to yield to oncoming traffic at an intersection, turned into an approaching vehicle, causing injuries to a passenger and $1,800 damage to both cars. The operator of the vehicle that attempted the turn was cited for failure to yield resulting in an accident. A passenger in that vehicle was treated for minor injuries at the Base Hospital Emergency Room and r released. The operator of a government vehicle failed to properly secure his vehicle causing it to roll into a fence. Damage to the vehicle and the fence cost taxpayers an estimated $400. The driver was cited for failing to properly secure his vehicle. ROY 8252285 23 Battery snatchers, D UIr Negligence spell trouble o o The Case of the Determined Battery Snatchers: Two criminals, in search of a car battery at "Midnight Auto Supply" were lifting fruits of the crime when the rightful owner, a base resident, set after them. The two escaped with only their hides, leaving behind the merchandise. Not to be discouraged, the team located a battery which was housed in another car in the housing area. This time, the resident was not aware of the culprit's activities. Result: One missing car battery. Ironically, the battery had been borrowed from another party. DUI Charges Filed on Three: Three Hill AFB people were arrested for DUI (driving under the influence) recently in three separate incidents. One officer and two airmen were incarcerated locally after having been arrested by authorities. One individual was booked into Weber County Jail after refusing to submit to the breathalyzer test.
