A changed parking configuration, con-figuration, which would allow cars to enter, drop off clients, and pull out without backing, was to be more completely outlined out-lined for council consideration. Marianne Kartchner proposed the facility as a place to provide daytime care for ambulatory am-bulatory individuals suffering the beginning stages of Alzheimer's disease. Kartchner said her mother is a victim of the disease, and the adult day care would be a way to help her, as well as providing respite for caregivers. Mayor Stella Welsh asked who has oversight over such a facility. Development Services Director Ed Stout said the day care would be licensed and overseen over-seen by the state's Department of Human Services. City Attorney Paul Johnson said the proposed facility would not come under the Fair Housing Hous-ing Act. The council could deny the project, but not easily, he said. Brad Stone, who lives directly direct-ly behind the proposed facility,' said he had researched the topic of adult day care facilities, which are becoming a booming trend or industry. There are currently no adult day care facilities in Orem. In Salt Lake City, however, they are not permitted in single family fami-ly residential zones, and are separately classified from child day care. Traffic patterns caused by such facilities are not conducive to residential areas, he argued. Other residents expressed concerns about children crossing cross-ing to and from nearby Orchard Elementary School during the same hours that people would be dropping off and picking up patrons of the care center. Area resident Mark Wycoff said the issue was "not a battle of us against them" residents versus the applicants. He maintained main-tained that a Pandora's box of conditional use for businesses in a residential area would be opened up. He said he and other residents were not concerned about the type of facility, but they feel the location is not a good one. "It's so easy when you're young," said Councilwoman Judy Bell. She said she took care of her mother for five years, and she would have given anything if she could have had a place like the proposed facility to take her to. She said she walked the site and 'would be willing to put it right next to her own property. Seniors, Bell argued, do better bet-ter in a neighborhood setting, and they "have earned the right to have some dignity." Stout said Orem's land use code does not have adult day care broken out from children's day care. Welsh said she did not object to the type of facility proposed, but she was concerned with the fact that children would be crossing the street "right there". Johnson said safety is a legitimate factor for the council to consider. The new driveway configuration reduces the danger, he said, but, "Is it enough to deny on that basis alone? It's a close question." Councilman Tim Christen-sen Christen-sen asked if the council needed to see a re-draft with the change proposed. Johnson said it was a significant enough change that the council probably ought to. Christensen said he, like Bell, felt the land use was appropriate. ap-propriate. He said if the applicants ap-plicants could mitigate the dropoff drop-off situation, he would be comfortable com-fortable with the proposal if it were reviewed every three months. . Bell withdrew a motion for approval and moved to continue the issue to the next meeting to give the applicants time to prepare a new site plan. Christensen Chris-tensen seconded the motion. Vote was 7-0 in favor of the motion.
