Standards and Requirements. Re-quirements. The development of a planned dwelling group shall conform to the following standards and requirements: re-quirements: A. The area proposed shall be in one ownership, or if in several ownerships, the application for the permit shall be filed jointly by all of the owners of the property pro-perty included in the plan. B. The plan shall cover an area of not less than four (4) acres. C. The final plan must be pre- pared by an architect and by an engineer who are both licensed to practice in the State of Utah. D. The number of dwelling units per acre shall be limited as follows: Not more than five (5) dwelling units per acre in the R-l ani R-l-A Agricultural Zones; not more than twelve (12) dwel ling units par acre in the R-2 Zone; not more than twenty dwelling dwel-ling units per acre in the R-3 Zone and in Commercial Zones. The dwelling may be situated in one building or buildings may be clustered and individual lot sizes may be reduced below the requirements of the zone in which the development is located, provided pro-vided the total number of dwelling units does not exceed the num- ber of dwelling units permitted- on one (1) acre, multiplied by jthe number of acres in the de- not contained in individual lots shall be set aside for parks and playgrounds and other uses designed de-signed for the common enjoyment of the occupants of the develop- men. In consider- ing the plan, the Planning Com mission, among other things, shall make sure that such development de-velopment will constitute a residential resi-dential environment of sustained desirability and stability, and that it will not produce a notic-ably notic-ably high volume of traffic, or : demand for utilities, or off-street parking and other public require- ments. (1) The City may require the developer to furnish and record re-cord protective covenants, which will guarantee the retention of the open land area or the City may require the creation of a corporation corpor-ation granting beneficial rights to the open space to all owners or occupants of land within the development. de-velopment. (3) In case of private reservation, the open space to be reserved shall be protected against building development by conveying to the City as part of the condition for project approval, an open space easement over such open areas, restricting the area against any future building or use, except as is consistent with that of providing landscaped open space for the aesthetic and recreational recre-ational satisfaction of the residents. resi-dents. Buildings or uses for noncommercial, non-commercial, recreational or cultural cul-tural purposes, compatible with the open space objectives, maybe permitted only with the express approval of the City, following review of building, site and operational oper-ational plans by the Planning Commission. Ownership and tax liability lia-bility of private open space reservations res-ervations shall be established in a manner acceptable to the City and made a part of the conditions of the plan approval. (5) Subse quent amendments may be made to the plan or use of the land upon approval by City Council and upon a petition of two-thirds (23) or more of the property owners within the development. Any subsequent sub-sequent change or addition to the plans or use of land shall first be submitted to thePlanningCom-mission thePlanningCom-mission for its recommendation. r(6) In case of failure or neglectf to comply with any and all of the conditions and regulations as herein established, and as specifically spe-cifically made applicable to a planned dwelling group, the Building Build-ing Inspector shall not issue a Certificate of Zoning Compliance therefor. Such failure or neglect shall be cause for termination of the approval of the project. Such failure 6r neglect to comply with the requirements and to main- in accordance with the conditions of approval thereafter shall also be deemed to be a violation of this Ordinance. 29-3-10-14-4. Before approval of a planned dwelling group can be given by the City Council, said City Council must hold a public hearing thereon in a manner man-ner similar to a request for an amendment to the Zoning Ordinance. Ordi-nance. Section HI. That the definition of dwelling group, planned, asset forth in Section 29-4-1 of the Re vised Ordinances of Orem City, Utah, 1959, as amended, be, and the same is hereby amended, modified and changed to read as follows: 'Planned Dwelling Group'An area of land developed develop-ed as a single entity for a number of dwelling units on one lot, '.he plan for which does not correspond corres-pond to the regulations in the zone in which the development is located. ! Section IV. That if anv part of this Ordinance should be declared invalid, such decision shall not affect the remainder of this Ordinance. Or-dinance. Section V. That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section VL That any person violating vio-lating any provision of this Ordinance Ordi-nance shall be guilty of a misdemeanor, mis-demeanor, and upon conviction thereof shall be punished by a fine in any sum aot exceeding Two Hundred Ninety -Nine Dollars ($299.00), or by imprisonment for a period of thirty days, or by both fine and imprisonment. Each and svery day such violation shall be continued, shall be considered a separate offense. Section VII. Because of impending development within Orem City, Utah, an emergency exists. In order to preserve the health, safety, convenience, peace, and general welfare of the City of Orem and the inhabitants thereof, this Ordinance shall take effect on its passage and first publication publi-cation in the Orem-Geneva Times, a newspaper of general circulation circula-tion within the City.
