According to Utah law, Wilbert J. Stewart, 44, could be sentenced to life in prison if he is found guilty of molesting a 12-year-old g'irl July 3 at The Canyons ski resort. She claims she pushed Wilbert's hands away about 15 seconds later. He was arrested July 7 and according to Brickey, during an interview with detectives, "Wilbert stated that he would plead guilty if taken before a court. Wilbert further admitted that while he was intoxicated, it was possible that he may have done what the girl described; however ... Wilbert denied the allegations and would not admit to them." Brickey would not comment further on the case on Monday but said a roll call hearing is scheduled for Wilbert in Silver Summit court on Aug. 31. "It's all false ... completely false," Stewart told The Park Record on Monday. "It's all fabrication." fab-rication." Mooney said Stewart has no history of child abuse. "In child abuse cases ... you can usually find a pattern of activity," he adds. "There's no pattern of activity." During interviews, Stewart's accuser was likely persuaded by some adults to misrepresent the facts. Mooney said. "There's some people I think that wrongfully went to prison before we understood how some of these worked," he adds. "Mr. Stewart asserts that he did nothing." noth-ing." He is also charged with failure to follow conditions of release for domestic violence, domestic violenceassault, two counts of commission of domestic violence in the presence of a child and intoxication, all misdemeanors. Deputies allegedly found two children locked in a room July 4 when they responded to Stewart's home at roughly 9:35 p.m. "According to the oldest daughter, Stewart struck his wife with a closed fist." states court information infor-mation filed by Brickey. "Officers made contact with Stewart's wife, and observed a black eye on the right side of her face. She indicated to the deputies that she had failed to awaken Stewart prior to dinner, and once he awoke he was upset with this fact and began fighting with her." The woman claims the man punched her "several times in the face," according to Brickey. According to court papers, Stewart is free on nearly $20,000 bail, but before leaving the Summit County Jail he agreed to have no contact with his wife. "The State would allege that after being released from the Summit County Jail. Stewart promptly returned to his home and attempted to enter the home occupied by his wife." states court information.
