Initial hearings were postponed post-poned for a third time a few days ago at the request of the defendant, Philip Neeves, a well-known real estate broker in Colorado Springs, where the trial will be held. Neeves' attorney, Richard Tegtmeier, requested more time for preparation of his case. Initial court hearings have been cancelled twice before. In December, the original presiding judge disqualified himself on the grounds of conflict of interest. David Zook, of the Economic Crimes Division of the El Paso county district attorney's office, told the Park City Newspaper a few days ago that he feels he has a very strong case against Neeves and is anxious to get the trial underway. Got wise The district attorney's office of-fice was tipped off about the scam by some of Neeves' victims, after they got wise. In early August 1982, one such investor flew to Park City. Upon investigation, he discovered that Neeves had no legitimate connection with Deer Valley. Many of the investors were apparently lured into the sight-unseen land deal because of Neeves good reputation in the Colorado Springs area. During the time Neeves was soliciting investors in the apparently phony options, he was also a licensed real estate broker working for the firm of Apollo West, Inc. He is no longer employed there. One woman who gave money to Neeves, who wishes to remain anonymous, told the "Denver "Den-ver Post" that she had invested in-vested tens of thousands after af-ter Neeves showed her a letter let-ter of credit for $500,000 from the First National Bank of Colorado Springs. The letter, on the bank's stationary, was signed by a vice chairman chair-man named John Carter. Fiasco According to the "Post," a senior officer at the bank claims that they have no knowledge of anything relating to the Neeves fiasco. First National says they have no record of any letter from their office concerning a line of credit for Neeves. They point out that the bank official named in the Neeves letter held the title of vice chairman. But no such office exists in the First National corporate heirarchy. What about "John Carter," Car-ter," the official signature on the bogus Neeves document? Gordon Culver, the bank's senior vice president, does admit that a John Carter was employed at First National.
