SECTION 2: This ordinance or-dinance was adopted by the City Council upon receipt of a petition by the owners of more than one-third one-third of the assessed value of the property described in Section 1 above, and by a majority of the owners of the property described in Section 1 above, as shown by the assessment rolls of the county, requesting annexation of the same by the City. SECTION 3: This ordinance or-dinance was adopted following the adoption by Springville City of an annexation policy declaration covering the area annexed in accordance ac-cordance with Utah Code Annotated 1953 section 10-2-414, as amended. Said policy declaration was adopted by the City Council on Septeiir 2, 1980, and amended October Oc-tober 20, 1981, following public hearings, notice of which was given as required by law. SECTION 4: The area described above in Section 1 is annexed to the City in accordance with said policy declaration and subject to the conditions con-ditions thereof concerning con-cerning the providing of various municipal services ser-vices to the area. In accordance ac-cordance with the policy declaration, the following conditions are adopted with respect to services in the said area: (1) The City will immediately im-mediately following the effective date of this ordinance provide fire and policy protection to the area and also garbage pickup. Existing regulations and charges for the garbage pickup service will be applied. (2) Construction of extensions of the city electrical transmission system in the area will be made by City personnel but all such extensions will be at the expense of the party or parties desiring the extension. Each extension will be made on a case by case basis by separate agreement with the City. The agreements may provide for a rebate on charges for electrical energy purchased by the party funding the extension ex-tension based upon the amount of electricity sold by the City to other parties through said extension. (3) City water mains may be extended into the area annexed at the expense of those making the extension. The City will not fund any such extension. All such extensions ex-tensions will be on a case by case basis by separate agreement with the City similar to those described in paragraph (2) above. It is the policy of the City to restrict the development of the area until water rights for the areas taken out of agricultural use are transferred to the City. Consequently, no building permits shall be granted for any non-agricultural non-agricultural construction within the area until the owner of the property upon which the construction con-struction is to take place complies with the requirements of Springville City Code (1979) section 11-7-402. (4) The City will not fund the construction of any sewer mains or pump stations in the area but may allow construction of the same at private expense ex-pense to connect to the existing municipal sewage treatment facilities under agreements similar to those described in paragraph (2) above. (5) The City will assume control of and maintain in their present condition all existing county roads in the area with the exception of 4800 South Street which shall remain a county road. The construction of new public roads in the area shall be at the expense of the party or parties desiring the same and no such road shall become a City street until dedication of the same has been accepted by the City upon such conditions hp City Council may The widening or ukc, udirife of any street within the area shall be at the expense of the parties January 28, James Wesley Skidmore James Wesley Skid-more, Skid-more, five-day old son of Wesley Rulon and Beverly Diane Childs Skidmore, died Jan. 23, 1982, at Utah Valley Hospital of prematurity. He was born Jan. 18, 1982, at Provo. His parents live at 250 E. 1300 N., Springville. Surviving are his parents, grandparents, Mr. and Mrs. France Childs, Bountiful; Mr. and Mrs. Wesley D. Skidmore, Potomac, MD; great-grandparents, Mr. and Mrs. Rulon G. Hegsted, Holliday, Utah. He was preceeded in death by a sister, Diane. Horace Walpole Prominent George Stoddard Ec-cles, Ec-cles, internationally known banker, financier and businessman, passed away January 20, 1982, in a Salt Lake City hospital making the improvement and-or the owners of abutting property. (6) As development of the area warrants, the City will consider the establishment of one or more special improvement im-provement districts in the area to fund the capital improvements to electrical, elec-trical, water, sewer and street systems or to provide other required municipal services. It is the policy of the City that no capital improvements in the area will be paid for from the City general fund. SECTION 5: Until otherwise provided by ordinance, the area annexed an-nexed shall be zoned CM, and the official zoning map shall so provide. SECTION 6: The official of-ficial boundary map of Springville City shall be amended to show the inclusion of the above described property within the City boundaries. SECTION 7: This ordinance or-dinance shall become effective 30 days after final passage hereof or 20 days after publication hereof as required by law or upon recording hereof in the office of the Utah County Recorder, whichever is the more remote from final passage. SECTION 8: Ordinance No. 28-80 is hereby repealed. The purpose of adopting this ordinance is to delete certain parcels from the area annexed. Deletion of those parcels is as a result of settlement of litigation in Fourth Judicial District Court of Utah County, Stae of Utah, captioned Har-ward, Har-ward, et al. v. Springville City, Civil No. 56408, and as a result of agreements between Springville City and Spanish Fork and Provo City establishing the ultimate boundaries of the three cities. This ordinance shall be construed con-strued as a re-enactment of Ordinance 28-80 with the changes contained herein. SECTION 9: The City Recorder shall cause such copies of the annexation an-nexation plat covering the above described property and certified copies of this ordinance as are required by law to be filed and recorded in the offices of-fices of the Utah County Recorder, Utah County Clerk, Utah Secretary of State, and Utah State Tax Commission. SECTION 10: The City Recorder shall cause this ordinance, or a short summary hereof to be published in the Springville Herald, a newspaper published in the City. He was born in Lehi on Aug. 22, 1918, a son of William T. and Emma E. Loveridge. He married Gwendolyn Elaine Smith on Sept. 11, 1943 and the marriage was solemnized later in the Salt Lake LDS Temple. Survivors include his wife: one son and one daughter William Lynn Loveridge, Ontario; Mrs. Allyn (Marilyn) Johnson, Panama City, Fla.; two grandchildren; five brothers and one sister, LeRoy Loveridge, Orem; Floyd Loveridge and Dr. Willard Loveridge both of Provo; Elwood Loveridge, Springville; Rodger Loveridge, Idaho Falls and Mrs. Don (Bessie) Nelson Brigham City. Eccles was born in Baker City, Oregon, in 1900, the third son of pioneer financier David Eccles and Ellen Stoddard Eccles. Most of his early education took place at Logan, Utah, where his family moved during his childhood. His summer months during early school years were spent in Baker, where, as a young boy, he was expected to work in his father's lumbering and construction business. He was married in 1925 to Dolores "Lolie" Dore. They maintained residences in Salt Lake City and Ogden, Utah, and in Palm Desert, California. Herald - Page Thirteen ill! it Vayne Zobell Vayne Zobell Vayne LaMar Zobell, 64, of 12 "C" Street, Springville, died Friday January 22, 1982, of a heart attack while on a Boy Scout camping trip. He was born June 12, 1916, at Springville, the son of Catherine Nelson and Harry Zobell. He married Tess Taylor on October 15, 1940, in the Manti LDS Temple. He was an active member of the LDS Church where he served as the deacons quorum advisor. He was an active Scouter for 19 years and received many awards including the Silver Beaver, Second Miler and Hobble Creek District Award of Merit. He served three years in the U.S. Navy during World War II, and was later employed by the Koepsal and Love Companies of Springville. He was later part owner of A & I Supply Company of Springville. He is survived by his wife of Springville, one son and one daughter, Steven LaMar Zobell of Springville, Kathleen Maycock of West Valley City; brother Gordon Zobell of ' Denver, Colorado, and sister Wanda Mitchell of Levan; three grandchildren, David, Diana, and Michael. Funeral services were Tuesday in the Kolob Stake Center. Burial was in the Springville Evergreen Cemetery, with full military rites by the District Four V.F.W. widow; brother, Willard L., Ogden, Utah; sisters, Mrs. S. J. (Jessie) Quinney, Salt Lake City, Utah, and Emma Eccles Jones, Piedmont, California. He was preceded in death by his brothers, Marriner S. and Spencer S.; sisters, Mrs. Hugh (Ellen) Harrison, Mrs. Richard (Nora) Harrison and Mrs. George (Marie) Caine. Funeral services are pending.
