The site area will be prepared by Springville City. Bituminous Material. The pavement aggregate shall conform to the State of Utah standard specifications for road and bridge construction, plant mix bituminous surface type B. The bituminous binder shall be asphalt cement and conform to ASTM D946. Bid Item. The bid item is to furnish, place, construct and compact Bituminous surface course on the mentioned parking lot. The asphalt shall be measured by the ton from weigh slips of the material delivered and placed. Basis of payment. Payment shall be made at the ton contract unit price. August 23, NOTICE OF ORDINANCE SPRINGVILLE CITY, UTAH Notice is hereby given that on July 17, 1979 the City Council of Springville, Utah, enacted an ordinance entitled "AN ORDINANCE OR-DINANCE ENACTING CHAPTERS 5 AND 6, of TITLE II OF CITY CODE OF SPRINGVILLE, UTAH, 1 9 7 9, PROVIDING THAT NO LAND WITHIN THE CITY SHALL BE SUBDIVIDED SUB-DIVIDED EXCEPT AS PROVIDED THEREIN; PROVIDING THE PROCEDURE FOR APPROVAL OF SUBDIVISIONS; SUB-DIVISIONS; SPECIFYING THE IMPROVEMENTS WHICH MUST BE JN-STALLED JN-STALLED By DEVELOPERS OF SUBDIVISIONS; AND PROVIDING FOR THE GURANTEES OF PERFORMANCE WHICH DEVELOPERS MUST PROVIDE." Said ordinance was enacted folowing a public hearing of which notice was given as required by law. The ordinance provides that no person may subdivide and sell land within the city except as provided therein. For subdivisions of ten lots or over, a subdivision plat is required. Land may be sold by metes and bounds if the subdivision contains less than ten lots and meets certain other requirements. All subdivisions sub-divisions must be approved ap-proved by the City Planning Commission. Those wishing to subdivide property must contact the Planning Commission staff, prepare a sketch plan, prepare a preliminary plan and improvement drawings, and a final subdivision plat. Once a subdivision has been approved by the planning Commission it must also be approved by the City Council, except that minor subdivisions need not receive Council approval if they meet the requirement of having less than ten lots and otherwise specified by the ordinance. Final approval ap-proval of a subdivision will not be granted by the City Council until the subdivider has posted a performance guarantee as required by the ordinance or-dinance to guarantee the installation of the required improvements. The ordinance specifies the improvements which the subdivider must install, in-stall, including graded and paved streets with all required culverts and drainage ways, sewer mains of not less than eight-inch diameter, water mains of not less than six-inch diameter, curb, gutter, sidewalk, fire hydrants, survey monuments, street lights, electric power, telephone, gas lines, street signs, storm drains. The City shall adopt standards and specifications which all improvements must meet and which the design of all subdivisions must meet. The subdivider must dedicate streets for public use. The sub-divider sub-divider is also required, in certain cases, to tender water rights to the City. Anyone violating the provisions of the ordinance or-dinance shall be guilty of a misdemeanor for each lot sold in violation thereof and shall be liable to punishmentjbv. a fine of up to $299, by imprisonment im-prisonment for up to 6 months, or both such fine and imprisonment. The ordinance also provides that a sub-divider sub-divider must post a cash or performance bond with sureties acceptable to the City Council in an amount of at least 125 percent of the estimated cost of all improvements which are to be installed by the subdivider. The schedule of release of that bond is specified and 10 percent thereof will be retained i ''..: .
