BY ADDING IU AND TO SAID CHAPTER, A NEW SECTION SEC-TION TO BE KNOWN AS SECTION 328, RELATING TO LICENSES. Be it ordained by the Board of Commissioners of Provo City, Utah: SECTION I. That Chapter 36 of the Revised Ordinances of Provo Pro-vo City. Utah, 1930, relating to licenses be, and the same is hereby here-by amended by adding in and to said Chapter 30, a new section, to be known as Section 328, which shall read as follows: Section 328. Within the scope and meaning of this ordinance, an "amusement device" is any machine, device or contrivance not prohibited or declared de-clared unlawful by any ordinance of Provo City, Utah, and particularly par-ticularly by Section 374 and Sec- ! tion 376 of Chapter 39, of the Revised Ordinance of Provo City, Utah, 1930, designed or intended to be operated or used fcr amusement amuse-ment or the playing of a game upon or in response to the pay- ! ment of some charge or the in- sertion therein of a coin, slug or check. I ill Hi" i i i A license, subject to the provisions pro-visions of this ordinance, shall entitle the person to whom the same is issued, to operate and use and to permit to be used and operated for the period for which the same is issued an amusement device in Provo City on or in any property or premises in his possession pos-session or under his control or on or fn the property or" premises In the possession or under the control con-trol of any other person whose consent thereto has been first obtained. Licenses shall be in the form of a label or sticker and must be pasted onto the amusement device de-vice on account of which they are issued. They shall contain the words, "Licensed Amusement Device De-vice No Issued to Expires They shall be numbered consecutively and be fore issuance, the City Recorder shall fill in upon the same, the number of the license, the year of issue, the date of expiration and the name of the licensee. For each license there shall be paid to the City Treasurer, a quarter-yearly fee of $3.00. Licenses shall be issued only for the quarter-yearly rate, and shall not be transferable, either as to licensee or amusement device. THE QUESTION IS, WHICH ONE . lUtr rNE" WF X v--.iMvJ 1: amusement device, except in re- j moving it therefrom by authority of the licensee, or to remove it or attempt to remove it therefrom without destroying it, or for any licensee to place it or permit it to be placed or be upon one amusement device after it has been placed upon another or to place it or permit it to be placed or be upon any machine, device or contrivance prohibited or declared de-clared to be unlawful by any Ordinance of Provo City, and par ticularly by Section 374 and Section Sec-tion 376 of Chapter 39 of the Revised Ordinances of Provo City, 1930. SECTION 2. Any person violating violat-ing any provision of this ordinance ordin-ance shall be punished by a fine of not less than $25.00 nor exceeding exceed-ing $299 00, or by imprisonment in the City Jail not longer than six months, or by both such fine and imprisonment. SECTION 3. In tiie opinion of the Board of Commissioners, it is necessary to the peace, health and safety of the inhabitants of Provo effective immediately. SECTION 4.
