Show Vernal Express Wednesday, April 17, 2002 13 Bench Press Why most people need legal help by Judge G.A. Mody" Petry First in a series about providing equal justice to all Americans. When we say the Pledge of Allegiance, we promise to support our country and its values of "liberty "liber-ty and justice for all." But what does "justice for all" mean, exactly? exact-ly? Our kgal system tries to guarantee guar-antee justice in many ways. For example, the U-S. Constitution says that: (I) "no one shall be deprived of life, liberty, and property without due process of law" (5th Amendment); (2) "in all criminal prosecutions, the accused shall enjoy the right., to have the assistance assis-tance of counsel (a lawyer for his defense" (6th Amendment); (3) "no state shall.. .deprive any person of life, liberty, or property without due process of law, nor deny to any person per-son w ithin its jurisdiction the equal protection of laws." (I4th Amendment). "Due process" means that people have the right to certain rules and procedures designed to assure fairness. fair-ness. For example, they have to be informed in advance of a legal case in which they are a party, and they have a right to a fair hearing, before an impartial judge. Our legal system sys-tem has developed formal rules to make due process a reality, covering cover-ing everything from selecting juries to presenting evidence. But hardly anyone who's not a lawyer knows all these rules or understands how to use them-and that can hurt in our "adversarial" system of justice. In this system, each side presents its case as effectively effec-tively as it can. The side that puts on the most convincing case should win. But what if you can't afford a lawyer? Hew do you put all these wonderful legal protections to use? Our system now guarantees that you will be given legal assistance if UHS welders score high in competition Uintah High School UBATC Welding students scored high in two state welding competitions. You're not guaranteed a lawyer if you're charged with an infraction (an offense in which the judge can't send you to jail) if you're facing eviction, or try ing to get child support sup-port or try ing to secure your rights in thousands of other kinds of civil cases. Question of the Week: Why isn't it legal for me to fasten my 4-year-old daughter in a regular seatbelt? Utah's seatbelt laws are found in Section 41 6-182. It says that the driver of a motor vehicle operated on a highway (this includes any street, road, freeway, as well as highway) shall: (a) wear a properly adjusted and fastened safety belt; (b) provide for the protection pro-tection of each person younger than S years of age by using a child restraint device to restrain each person; per-son; and (c) provide for the protection protec-tion of each person 5 years up to 16 years by using an appropriate child restraint device. Research has shown that unless a child is at least 4'9" tall and weights 90 lbs., the regular vehicle seatbelt system is not appropriate to ensure the child's safety. Why take chances? Obtain an approved booster seat system to restrain your child. It doesn't make sense for you to take more care to make sure your diet soda doesn't tip over in the car than making sure your child doesn't turn into a human pinball inside your vehicle.
