ORDINANCE NO. 6-4-91 DATE 8-10-99 AN ORDINANCE ENACTING CHAPTER CHAP-TER 3.06 UINTAH COUNTY CODE OF ORDINANCES, 1986, AS AMENDED, RELATING TO THE IMPOSITION AND COLLECTION OF A TOURISM, RECREATION, RECRE-ATION, CULTURAL AND CONVENTION TAX. The Board of County Commissioners of the County of Uintah ordains as follows: SECTION I. That effective effec-tive July 1, 1999, Chapter 3.06, Uintah County Code of Ordinances, 1986, as amended, is hereby enacted as follows: fol-lows: Chapter 3.06 TOURISM, RECREATION AND CONVENTION TAX Sections: 3.06.010 Provisions 3.O6.020 Statutory Authority 3.06.030 Purpose of Provisions 3.06.040 Definitions 3.06.050 Imposition -Amount 3.06.051 Use of Revenues 3.06.060 Collection 3.06.070 Licensure 3.06.010 Provisions The ordinance codified in this chapter shall be known as the Tourism, Recreation, Cultural and Convention Tax of the County of Uintah. 3.06.020 Statutory Authority. The authority for imposing this tax is derived from Title 59, Chapter 12, Section 601 et seq. Utah code Annotated 1953. 3.06.030 Purpose of Provisions. The ordinance codified in this chapter is enacted to provide the County with a source of revenue specifically for the purpose pur-pose of financing in whole or in part the development, operation and maintenance of tourist, recreation, cultural cultur-al and convention facilities facili-ties and the Board of County Commissioners hereby directs that the provisions hereof be interpreted and consulted to accomplish the stated purpose. 3.06.040 Definitions As used in this ordinance: ordi-nance: (1) "Convention facility" facili-ty" means any publicly owned or operated convention con-vention center, sports arena, or other facility at which conventions, conferences, con-ferences, and other gatherings gath-erings are held and which primary business or function func-tion is to host such conventions, con-ventions, conferences and other gatherings. (2) "Recreation facility" facili-ty" or "tourist facility" means any publicly owned or operated park, campground, camp-ground, marina, dock, golf course, water park, historic park, museum, theater, monument, planetarium, plan-etarium, bicycle trails, and other recreation or tourism related facility. (3) "Cultural facility" means any publicly owned or operated museum, muse-um, theater, art center, music hall or other cultural cultur-al or arts facility. (4) (a) "Restaurant" means any facility where food is prepared for immediate consumption, including but not limited to coffee shops, restaurants, restau-rants, luncheonettes, soda fountains, fast food services ser-vices or outlets, and all other similar facilities. (b) "Restaurant" does not include any retail establishment whose primary pri-mary business or function is the sale of fuel or food items for off-premises, but not immediate, consumption. con-sumption. (5) "Short-term lease or rental of motor vehicles" means any lease or rental of a motor vehicle not exceeding thirty (30) days in length. A lease or rental of motor vehicles when made for the purpose pur-pose of temporarily replacing a person's motor vehicle that is being repaired pursuant to a repair or insurance agreement and which is supported by a written agreement, shall not be short-term lease or rental of i motor vehicle subject to taxation under this ordinance. 3.06.050 Imposition-Amount Imposition-Amount There is hereby levied for collection tourism. recreation, cultural and convention taxes on the following activities at the rales set forth below: (1) A tax is hereby ' imposed at the rate of 3 of the lease or rental amount an all short-term leases and rentals of motor vehicles as defined herein which are made within Uintah County. The short-term motor vehicle rental shall be deemed to have occurred within Uintah County, if the rental is or would be subject to a local option sales and use tax ordinance ordi-nance of Uintah County or any city or town in Uintah County. . (2) A tax is hereby imposed on all restaurants, restau-rants, as defined herein, Uintah County at the rate of 1 on all sales by the restaurant of beverages and prepared foods. 3.06.051 Use of Revenues. 'The revenues received from the tourism, recreation, recre-ation, cultural and convention con-vention taxes levied pursuant pur-suant to 3.06.050 (I) and (2) shall be used solely for the purposes of financing, in whole or part, tourism promotion, and the development, operation, and maintenance mainte-nance or tourist, recreation, recre-ation, cultural, convention conven-tion facilities as defined herein. 3.06.060 Collection. Taxes imposed under this chapter shall be levied at the same time and collected in the same manner as prov ided for in Title 59, Chapter 12, Section 201 et seq. (1953, as amended) except that the revenue derived from the tax is not subject to the collection and distribution distrib-ution procedures established estab-lished pursuant to the provisions of Subsection 59-12-205(2), Utah Code Ann. 1953, as amended. 3.06.070 Licensure. All persons, companies, corporations or other similar sim-ilar persons, groups, or organizations engaged in the business of short-term rental or motor vehicles or doing business as restaurants shall obtain, from the State Tax Commission, a tourism, recreation, cultural or convenient tax license. No such additional license shall be required if the person, company, corporation, group or organization has obtained a license pursuant to Section 59-12-106 Utah Code Ann. (1953, as amended).
