PUBLIC NOTICE REQUEST FOR COMMENTS MOSBY CANAL OPERATION AND MAINTENANCE PLAN AND PERMIT AMENDMENT USDA - Forest Service Ashley National Forest Uintah County The Vernal Ranger District Dis-trict of the Ashley National Nation-al Forest has received an Operation and Maintenance Mainte-nance Plan for the Mosby Canal and Julius Park Reservoir, from the Mosby Mos-by Irrigation Company. This Plan, which will guide future work on the canal and reservoir and provide for adequate protection pro-tection of National Forest System lands and resources re-sources associated with the continued operation of these facilities, is being considered for approval. The Mosby Canal and Julius Park Reservoir are presently authorized by special use permit, which expires on December 31, 1997. The Mosby Irrigation Irriga-tion Company has applied for a conditional permanent perma-nent easement which would authorize the canal and reservoir and would have no termination date, contingent upon the holder hold-er complying with the terms of the easement. An Act of the United States Congress, dated October 27, 1986, also commonly referred to as the Colorado Ditch Hill, directs the Secretary of Agriculture (through the Forest Service) to issue conditional permanent easements, for agricultural agricultur-al irrigation and livestock watering, to all who apply for and meet specific qualifying criteria in the Act. Therefore, after a review re-view of their application pursuant to the Act, the Mosby Irrigation Company Compa-ny is eligible for the issuance is-suance of an easement. Until such time that this easement can be granted, the Forest Service plans to issue an amendment to the existing special use permit to extend the termination ter-mination date for a period of one year, or December 31, 1998. During this time, improvements will be made to the canal to upgrade it as directed by past permit inspections. The easement, once granted, grant-ed, will contain the Operation Oper-ation and Maintenance Plan as part of the authorization. autho-rization. NOTICE OF PUBLIC HEARING Corrections for Permitting Process To clarify and correct rules which streamline the permitting process for small sources of air pollution, pollu-tion, the Air Quality Board has amended R307-1-3.1.7, and the rule is in effect under state law. A public hearing on those changes was held on May 20, 1997. However, Howev-er, in order to be federally enforceable under the provisions pro-visions of state implementation implemen-tation plans, another hearing hear-ing must be held. If comments com-ments are received, the Board will consider whether to propose additional addi-tional changes in the rules through the regular state rule making process. The changes under consideration con-sideration are: first, R307-l-3.1.7.A(l)(b) was amended to clarify that any source which is subject sub-ject to the offset provisions provi-sions of R307-1-3.3.3 cannot be considered de minimis. Second, the wording of R307-1-3.1.7.A(l)(d), (e), and (f) and R307-1-3.1.7.B(2) and (3) were clarified to reflect the original intent of the rule that sources with less than 5 tons per year of hazardous air pollutants pol-lutants that are also volatile organic compounds com-pounds are not de minimis min-imis sources. Third, R307-1-3.1.7.A(3) was added to clarify that small sources are subject to the relocation notification requirements re-quirements of R307-1-3.1.9. Fourth, R307-1-3.1.7.A(2)(g) was added to require sources in the nonattainment areas to include, in-clude, as part of their registration, reg-istration, information demonstrating that the source is not a major source. Finally, R307-1-3.1.7.D allows exemptions exemp-tions from the approval order requirements for replacement-in-kind equipment. equip-ment.
