S. 2477 comment period Plan reports progress Pursuant to the request of Western Senators including Senator Bob Bennett (R-Utah), Interior Department Secretary Bruce Babbitt has agreed to a six-month extension of the public comment period on the proposed changes affecting af-fecting R.S. 2477 roads allowing the Utah State Legislature a chance to respond. "I am grateful for Secretary Babbitt's recognition of the stifling effects the proposed changes of R.S. 2477, not only in Utah, but potentially poten-tially all of the West With this extension, ex-tension, the Utah Stale Legislature will now have an opportunity to respond re-spond to the new regulations. Without this extension, the voices of our state legislators would have gone unheard," Bennett said. The public comment period was resting with the local governments. "Many Utah county commissions have insisted that with hundreds of rights of way in dispute, they could not possibly meet Interior's proposed pro-posed deadline even when the local case was indisputable," Bennett said. Senator Orrin Hatch (R-Utah) co-authored co-authored the letter to Secretary Wheat, corn and barley storage down December 1 stocks of wheat, corn and barley in Utah's mills and elevators ele-vators (off farm locations) were at lower levels than the previous year according to the Utah Agricultural Statistics Service. All wheat stored at off-farm locations loca-tions totaled 3.26 million bushels on Dec. 1, 1994, which was 45 percent lower than the previous year. Stocks of corn were 573,000 bushels, down 1 percent from Dec. 1, 1993. Total barley stored (on and off farms) in Utah on Dec. 1, 1994, at 5.06 million bushels, was down 34 percent from the previous year's level. Barley stored on Utah farms, at 3.3 million bushels, accounted for 65 percent of the stocks. Nationally, corn stocks in all positions posi-tions on Dec. 1, 1994', totaled 8.08 billion bushels, up 36 percent from Dec. 1, 1993. All wheat stored in all positions Dec. 1, 1994, totaled 1.50 billion bushels, down 6 percent from Dec. 1, 1993. Barley stored in all positions on Dec. 1, 1994, is estimated at 279 million bushels, down 16 percent from the stocks of Dec. 1, 1993. Oats stored in all positions on Dec. 1, 1994, totaled 192 million bushels, 1 percent below Dec. 1, 1993. Commercial fruit production Utah's final 1994 commercial fruit utilized production estimates were down from the previous year for apples ap-ples and pears but up from the previous pre-vious year for apricots, sweet cherries, cher-ries, tart cherries and peaches, according ac-cording to the Utah Agricultural Statistics Service. Apple utilized production totaled 42 million pounds compared with 50 million pounds during 1993. Apricots, at 380 tons, compared with 240 tons in 1993. Sweet cherry utilized production, at 2,250 tons, compared with 1,200 tons the previous previ-ous year. Tart cherries utilized totaled to-taled 22.0 million pounds, up 293 percent from last year. Peach utilized uti-lized production totaled 6.6 million pounds compared with 5.8 million pounds a year earlier. Pears utilized totaled 1,000 tons, down 29 percent from 1993. Preliminary value of production for Utah's fruit crop and percent change from 1993 are as follows: apples, $5.8 million, down 5 percent; per-cent; apricots, $194,000, up 54 percent; per-cent; sweet cherries, $2.0 million, up 77 percent; peaches, $1.5 million, mil-lion, up 9 percent; pears, $360,000, down 36 percent Nationally, 1994 fruit utilized production pro-duction compared with 1993 is as follows: apples, up 2 percent; apricots, apri-cots, up 49 percent, sweet cherries, up 20 percent; tart cherries, up 9 percent; peaches down 6 percent; pears, up 9 percent scheduled to expire Jan. 14, 1995 and will be extended until July 14, 1995. The Utah State Legislature was not scheduled to convene until after the Jan. 14 deadline. Bennett noted that under the proposed pro-posed rules, the Clinton Administration would not recognize local rights of way over public lands unless they were established between 1866 and 1976 and used by vehicles, with the burden of proof Vernal City SECRET WITNESS ' Program 709-0008 Babbitt along with Senator Bennett and Five other Western Senators requesting re-questing the extension. R.S. 2477 is a historical hangover, a provision of the Mining Law of 1866 that said, simply, that "the right of way for the construction of highways over public lands, not reserved re-served for public uses, is hereby granted." Although Congress repealed re-pealed the statute in 1976, it did not terminate rights of way in existence at that time. The problem has been the lack of a process and standards for determining when valid rights of way do exist. Public land users and managers have sought an end to the uncertainty, and in 1992 Congress asked the Secretary to study the problem and recommend a solution. In 1993, the Secretary issued a, report re-port to Congress recommending the rulemaking now under way. Due to a request from the public, the High Uintas Wilderness planning plan-ning team will hold progress report meetings this week. Forest Service managers will answer questions on issues and alternatives developed from comments received from the public. The issues and alternatives document will be available at the meetings or by calling Gayne Sears at (801) 722-5018.
