The bid will be final and not subject to quarterly adjustment. This is a pre-sale measurement sale and flat rate sale. All cutting will be done by the individual in-dividual tree selection method. The sale contains con-tains 1 unit which is 398 acres in size. Trees that are now green may be killed in the near future. The sale will not be reappraised because of catastrophic mountain pine beetle damage. The timber contract is a short term contract which requires that all timber be removed and all contractural obligations obliga-tions be completed by March 31, 1986. The required bid guarantee is $500.00. The bid guarantee shall be in the form of a firm commitment com-mitment such as cash, bank draft, postal money order, bid bond, certified check, or cashier's check. The high bidder whose bid is accepted must, within 30 days of receipt of written notification, furnish a cash deposit in the amount of 10 percent of total bid value rounded round-ed up to the next $100.00. A performance bond is required for this sale. The minimum performance perfor-mance bond will be $2000.00. Timber included in this contract is subject to log export and substitution restrictions of 36 CFR 223.10 (FSM 1023.4, 2430.9). After construction is complete, it is proposed that the system be turned turn-ed over and transferred to the Ashley Valley Water and Sewer Improvement Im-provement District to be by it operated and maintained main-tained thereafter. Section 7: It is proposed propos-ed that after the formation forma-tion of the District the City Ci-ty of Naples shall, pursuant pur-suant to statute, be permitted per-mitted and authorized to secure loans for the dut-poses dut-poses herein outlined and set forth; and to issue bonds or debentures therefor. Said bonds or debentures are to be secured by special assessments, payable over a period of years, to be levied on each lot or tract of land where a con-ection con-ection is made or provided provid-ed for to the sewer system. Said assessments shall attach to the land and the land shall be security therefor as set forth and provided for by statute. (Title 10, Chapter 16, Utah Code Annotated). Section 8: It is proposed propos-ed that said Improvement Improve-ment District shall be vested with all of the rights, privileges, and prerogatives of any special improvement district organized under the provisions of Chapter 6, Title 10 Utah Code An notated (1953) as amended amend-ed and shall be subject to all the limitations, obligations and restrictions restric-tions set forth in the above mentioned statute now provided for or any that may hereinafter be prescribed by law. Section 9: It is proposed propos-ed that as soon as possible possi-ble the District acquire a complete and adequate sewer system sufficient to provide for the needs of the residents and inhabitants in-habitants of the land within said District in accordance ac-cordance with the engineering studies in connection therewith. Section 10: The estimated cost of the sewer system improvement improve-ment proposed to be constructed con-structed by the High Country Special Improvement Im-provement District is approximately ap-proximately $300,000. Pursuant to statute, such estimate shall not constitute con-stitute a limitation on the Improvements to be constructed con-structed by the District. Section 11: It Is proposed propos-ed that part of the estimated cost of construction con-struction shall be raised by the Issuance of the District's general Obligation andor Revenue bonds or such other delxmlure as Is appropriate, ap-propriate, the same to be paid by the levy of special aweiwrnentj on the property.
