Show Street and 100 North Street be, and the same is hereby, vacated as street, which said portion of 500 West Street is more particularly described as folio vs: . . Beginning on the North Line of a street at the comer of Lot 1, Block 13, Plat "A", Kaysville Townsite Survey, and running thence North 180-44 feet along cast line of said Lot 1 to the Highway right-of-way line; thence South 16 degrees 22 East. 188.06 feet along said highway right-of-way to the north line of said street; thence west 53.00 feet along north line of said street to the point of beginning. SECTION 2; TRANSFER OF VACATED PROPERTY That portion of 500 West Street being be-ing vacated as provided herein shall be transferred and conveyed by Quit Claim Deed from Kaysville City to Melvin A. Mertlich. The City reserves and retains a perpetual utility easement on, over, across, and through a ten foot (10') strip of property lying contiguous to and inside the entire south boundary of said property for the purpose of maintaining existing utilities, if any, including the right to enter upon such property for the purposes or installing, install-ing, maintaining, repairing, replacing and expanding such utilities and for the purpose of installing additional utilities upon such property at any time in the future. SECTION 3. RECORDING OF ORDINANCE That upon passage of this Ordinance, Or-dinance, a copy hereof shall be recorded by the City Recorder in the Office of the County Recorder of Davis County, State of Utah. SECTION 4: EFFECTIVE DATE In the opinion of the City Council, this Ordinance is necessary and desirable for the peace, health, and safety of Kaysville City and the inhabitants in-habitants thereof. Therefore, this Ordinance Or-dinance shall take effect immediately upon passage and publication as required re-quired by law. OWNER-SHIP. WHEREAS, the governing body of Kaysville City has determined within the meaning of Section 10-8-8.2, Utah Code Annotated, 1953, that there is good cause for vacating that portion of 500 West Street between Center Street and 100 North Street; and WHEREAS, the City has caused to be published a "Notice of Public Hearing Hear-ing to consider vacating a portion of 500 West Street, Kaysville Chy, Davis County, State of Utah" for the purpose of calling a Public hearing to consider the question of whether or not the portion por-tion of said street should be vacated, said Notice having been given andpub-lishcd andpub-lishcd pursuant to and in accordance with the terms and provisions of Section 10-8-8.4, Utah Code Annotated, 1953; and, WHEREAS, said Public hearing was held at the Kaysville Municipal Center at 7:30 o'clock P.M. on Tuesday, January 8, 1991; and, WHEREAS, after due deliberation by the Mayor and City Council, it is now found and determined that there is good cause for vacating said portion of 500 West Street and that such vacation will not be detrimental to the general interest in-terest and that it is in the best interests of the City and its inhabitants to vacate said portion of said 500 West Street; NOWt THEREFORE, BE IT ORDAINED OR-DAINED BY THE CITY COUNCIL OF KAYSVILLE CITY, as follows: SECTION 1: PORTION OF 500 WEST VACATED That all of that portion of 500 West Street, Kaysville City, Davis County, State of Utah, lying between Center |
