Show Case summary Major points in Hale-Wharton Case against KSL for removal of on issues of concentration of media control and censorship. May 1968: Citizens group including minority citizens meets to discuss problem of communications in area, many later become members of the QRM Committee for Better Broadcasting. July 1968: FCC formally advised of intent to challenge KSL renewal, August, FCC advised of local cartel-like arrangements among newspapers news-papers and electronics media October 1968: FCC votes three to one in favor of KSL renewal October 15: Petition for re-consideration filed by Hale-Wharton to FCC and amended Nov. 6 November 19: Wilkinson, Cragun and Barker, KSL counsel file opposition to petition and suggest that the FCC should conduct "its own independent inde-pendent investigation" of Miss Hale and Mr. Wharton. January 22, 1969: FCC denied petition for reconsideration by a three for and three against vote. One abstention. Services were obtained without fee and as a public service of Mr. Robert N. Levin of Freedman and Levin of Washington D.C., by Hale- Wharton. Appealed FCC decision to Circuit Court of Appeals, Washington D .C. KSL files notice in court of intent to intervene FCC grants hearing on KRON TV (owned by San Francisco Chronicle) and WCCO in Minneapolis. Concentration of ownership, news distortion are the issues. Hale-Wharton ask court to hold case in abeyance, FCC appealed to again on grounds of new FCC policy decisions, plus outcome of Supreme Court hearing on Tuscon, Arizona newspaper case in which set-up similar to Deseret News-Salt Lake Tribune-newspaper Agency Corporation is found in violation of anti-trust laws. FCC had previously agreed to reconsider Hale-Wharton depending on outcome of Tucson case. Court denies KSL request for abeyance, grants Wharton-Hale request for court to retain jurisdiction over case. KSL asks court to dismiss case because Hale-Wharton alledgedly lack standing before court. Court denies KSL request and continues to act on case. Court also denies two more KSL requests. FCC in another three-three tie vote deny Wharton-Hale KSL hearings at reconsideration action. Commissioners Bartly, Cox, and Johnson all democrats de-mocrats voting for Hale-Wharton. Other three all Republicans including Rosel Hyde, Chairman of the Commission voting for KSL. Mr. Hyde is a Mormon and High Counselor in the Washington Stake of the L.D.S. Church. Seventh Commissioner H. Rex Lee who is a freshman member of the commission continues not to vote. (Mr. Lee is an Idaho Democrat and a Mormon). : June 1969: FCC votes six to zero to send Wharton-Hale information to the Justice Department for investigation of KSL anti-trust. Attorney Levin continues case with FCC on KSL before Washington D.C. Circuit Court of Appeals. Wharton-Hale are trying t ,aise money for court costs with the "QRM" Committee at P.O.
